Title of bill
An act to amend the alcoholic beverage control law, in relation to a license to sell liquor at retail for consumption on certain premises
Purpose
This bill would allow Tony & Nick's Italian Kitchen to obtain a full liquor license for the on-premises consumption of alcohol.
Summary of provisions
Section 1:Amends subdivision 7 of section 64 of the Alcohol Beverage Control Law, adding a new paragraph (e-8) to allow the issuance of a retail license for on-premises consumption of alcohol for a premises within 200 feet of a school or place of worship, provided that the purpose of such premises is for the sale and consumption of food or beverage, and such premises is within the boundaries of Ulster County as directed therein.
Section 2:Effective date.
Justification
Tony & Nick's Italian Kitchen is a casual Italian dining and catering establishment in the Village of Ellenville, New York with a currently valid beer and wine license. While the Alcoholic Beverage Control Law prohibits the sale for on-premises consumption of alcohol at any location within 200 feet of a place of worship or school, exceptions have been made for certain establishments that do not pose problems for the place of worship, school, or surrounding neighborhood.
Tony & Nick's is located in a restaurant cluster that serves as a catalyst for renewed economic growth in the Village of Ellenville, which is nestled in the foothills of the Shawangunk Mountains ranges in Southwestern Ulster County. By providing Tony & Nick's with an exemption to the current provision, it will be in a position to draw in tourists by not only offering a fine dining menu but also by meeting customer expectations with an inventory of local and international alcoholic beverages. Additionally, a separate restaurant, Aroma Thyme Bistro, which is located directly across the street from Tony & Nicks, received a similar exemption in 2005. Further, the church that is located within 200 feet of the restaurant utilizes a main entrance that is separate and farther away from the entrance stated by the property's official address.
