Title of bill
An act to amend the executive law, in relation to standards for inspections of parking structures
Purpose
The purpose of this bill is to ensure that parking structures statewide receive regular structural stability inspections.
Summary of provisions
Section 1 of the bill amends section 378 of the Executive Law by adding subdivision 17, which establishes the standards for the inspection of parking structures.
Section 2 amends section 372 of the Executive law by adding subdivision 20, which defines parking structures.
Section 3 is the effective date.
Justification
Municipalities throughout the state are faced with aging infrastructure. Parking structures are a critical infrastructure component. Within the last year, we have seen parking ramps collapse or shut down because they were a threat to public safety.
There are currently no state or federal requirements for periodic structural stability inspections of parking structures. Fire safety and property maintenance inspections are required as part of municipal code inspections every three years, but inspections of the actual structural stability of the structures are left up to the owner.
Requiring periodic inspections of parking structures is necessary to protect the public from any potential harm and serve as a planning tool for owners of the structures to stabilize them. This legislation will add structural stability inspections to the State Building Code and proactively address a growing public safety concern.
