Title of bill
An act to amend the retirement and social security law, in relation to the retirement allowance of certain retired persons employed by a community college
Purpose
To provide police and fire retirees a continuous waiver of their pension limitations during their time as a fill-time teaching faculty member under a criminal justice, fire science, or emergency management program of a community college in the state university of New York system, or the city university of New York system.
Summary of provisions
Section 1 grants retired New York police and fire pensioners a continuous pension waiver to be employed as a full-time teaching faculty member at a community college in the SUNY or CUNY systems in the fields of criminal justice, fire science, or emergency crisis management.
Section 2 grants retired New York police and/or firefighters currently employed as full-time teaching faculty members at a community college in the SUNY or CUNY system in the fields of criminal justice, fire science, or emergency crisis management a continuous pension waiver.
Section 3 establishes the effective date.
Justification
As a result of their former employment, retired police and firefighters have extensive training and qualifications in, inter alia, the fields of criminal justice, fire science, and emergency management. Consequently, they are sought as instructors and/or seek teaching positions as instructors in such fields post-retirement. However, due to their status as public pensioners they are essentially constrained from accepting such teaching positions at public universities and colleges. As a result, private institutions, alone, are able to retain their skill set and knowledge base as instructors. This bill would allow public universities and colleges in New York to retain the valuable skills and knowledge of retired police and firefighters as instructors in fields such as criminal justice, fire science, and emergency management.
