Sponsor's memo

Title of bill

An act to amend the public health law, in relation to minors' consent to HIV/AIDS testing, treatment and prevention

Purpose

To enhance access to HIV-related prevention and treatment by authorizing minors to consent.

Summary of specific provisions

Section 1 adds a new § 2781-b to the Public Health Law authorizing minors' consent to HIV testing, prevention and treatment.

Section 2 provides for an immediate effective date.

Justification

Under NYS law, competent minors are allowed to consent to HIV testing without parental consent, but they do not have the statutory right to consent to prophylaxis for HIV or HIV treatment. These limits on a minor's right to consent can present a significant barrier to treatment and prevention. This bill would extend a minors' right to consent to treatment and would also assure that such information remains confidential so as not to create a barrier to accessing prevention and treatment services.
