Title of bill
An act to amend the town law and the public officers law, in relation to waiving the residency requirement for the town board-appointed officers in the town of LaGrange, Dutchess county
Purpose
To waive the residency requirements for certain town officer positions in the town of LaGrange in Dutchess County.
Summary of provisions
Section 1: Validates, legalizes, ratifies and confirms the employment of three town officers in the town of LaGrange which is currently in violation of section 3 of the public officers law and section 23 of the town law with regards to residency requirements.
Section 2: Amends Section 23 of the town law by adding a new subdivision 30 to waive the requirement that the person performing the functions of building inspector, comptroller and administrator of public works in the town of LaGrange, Dutchess County are electors of such town.
Section 3: Amends Section 3 of the public officers law by adding a new subdivision 65 to waive the requirement that the person holding the offices of building inspector, comptroller and administrator of public works in the town of LaGrange, Dutchess County be a resident of such municipal corporation, provided that said such a person resides in Dutchess County or an adjoining county within New York State.
Section 4: Provides the effective date.
Justification
After taking office and reviewing town laws, the town of LaGrange Supervisor noticed that several of the town officer positions would be considered non-compliant due to residency requirements. Through a resolution, the town has expressed their desire to allow all three members to continue to perform their respective duties as town officers due to their experience and deep town knowledge and do not wish to replace them. Each of these town officers have been in their position for at least eight years, and this bill would give the town the ability to keep them on in their current positions without being considered non-compliant.
