Title of bill
An act granting retroactive tier II membership in the New York state and local employees' retirement system to Todd Mikus
Purpose
This bill would grant Tier 2 status in the New York State and Local Employees' Retirement System (NYSLERS) to Todd Mikus, a current Tier 4 member.
Summary of provisions
Section 1 would grant Todd Mikus Tier 2 status in NYSLERS for the time he was employed by the Poughkeepsie City School District in 1976.
Section 2 requires Dutchess County to incur any past service costs.
Section 3 sets an immediate effective date.
Justification
Todd Mikus, a current Tier 4 NYSLERS member employed by Dutchess County is seeking Tier 2 status in the retirement. In 1976, Todd Mikus was employed by the Poughkeepsie City School District and through no fault of his own, he did not become a member of the NYSLERS at that time. This bill would allow him to file an application to entitle him to every right, benefit and privilege as a Tier 2 member. Mr. Mikus would not be entitled to a refund of any employee contributions made by him to the retirement system and Dutchess County would be responsible for the past service costs.
