Title of bill
An act relating to the eligibility of Earnest Cawley Jr. to take the competitive civil service examination for the position of police officer in the town of Colchester, in the county of Delaware and to be placed on the eligibility list for appointment as a full-time police officer
Purpose
To allow Earnest Cawley Jr. to take the civil service examination to become a full-time police officer in the Town of Colchester.
Summary of provisions
Section 1: Provides that notwithstanding the provisions of section 58 of the Civil Service Law or any other provision of law to the contrary, Earnest Cawley Jr. shall be eligible to take the competitive civil service examination for the position of police officer, and contingent upon passing, be eligible to be listed for appointment as a full-time police officer for the Town of Colchester.
Section 2: Provides that Earnest Cawley Jr. shall otherwise be subject to the merit and fitness provisions of the civil service law applicable to full-time police officers.
Section 3: Effective date.
Justification
New York Civil Service Law prohibits individuals over the age of 35 from taking the exam to become a full-time police officer. Earnest Cawley Jr. previously was a Deputy Sheriff for Delaware County and has been working as a part-time police officer for the Town of Colchester Police Department since 2014. However, between the time he left the Sheriff's office and the time a full time officer position was available in the Town of Colchester, more than a year had passed and his civil service status had lapsed. This legislation was introduced at the request of the Town of Colchester in order to let Earnest Cawley Jr. take the civil service exam to become a full-time police officer.
