Title of bill
An act to amend chapter 330 of the laws of 2011 amending the town law relating to payments for certain school, fire, fire protection, and ambulance districts for lands exempt from real property taxation for purposes which implement the Peconic Bay community preservation fund, in relation to such payments
Purpose
To make clear that payments made from the Peconic Bay Community Preservation Fund (CPF) to schools and other special districts are not included as part of the tax levy.
Summary of provisions
Section 1. Section 2 of Chapter 330 of the Laws of 2011 amending the town law relating to payments for certain school, fire, fire protection, and ambulance districts for lands exempt from real property taxation for purposes which implements the Peconic Bay Community Preservation Fund, as added by Chapter 396 of the Laws of 2015, is amended to provide that CPF payments made pursuant to this Section be not included in the tax levy for purposes of calculating the tax levy limit pursuant to Section 3-c of the General Municipal Law and Section 2023-a of the Education Law.
Section 2 provides for the effective date.
Justification
Under current law, the Town of Southampton is permitted to make annual payments from its CPF to certain high-tax school, fire, fire protection, and ambulance districts which have been taken off the tax rolls. As such, the Riverhead Central School District, Hampton Bays Union Free School District, the Eastport-South Manor Central School District and the East Quogue Union Free School District are eligible to receive payments from the CPF for protected lands within such school districts to help mitigate the impact of the lost tax revenues and reduce the burden on taxpayers. However, these payments are added to the tax base growth factor and in some cases, are contributing to districts exceeding the 2% tax levy limit.
This legislation would provide that payments made from the Peconic Bay CPF to schools and other special districts will not be included as part of the tax levy.
