Title of bill
An act to amend chapter 524 of the laws of 1987, relating to establishing the Greater Poughkeepsie library district, in the city and town of Poughkeepsie, Dutchess county, in relation to the election of trustees and the annual budget of such library
Purpose
To clarify the election process for the board of trustees of the Poughkeepsie Library District and to require the trustees to hold the annual budget vote on the date of the general election.
Summary of provisions
Section 1: Establishes the procedures for the election of library trustees of the Poughkeepsie Library District, including the requirements for providing notice of such election and for nominating candidates by petition, in addition to establishing a two-thirds quorum for the trustees. Also adds that the election of such trustees shall take place on the same day and ballot as the general election as administered by the board of elections with the results being certified by the board of elections.
Section 2: Requires that the library district's proposed budget be placed on the same day and ballot as the general election as administered by the board of elections with the results being certified by the board of elections.
Section 3: Establishes the effective date.
Justification
In 2014, the Dutchess County Board of Elections notified the Poughkeepsie library district that the Board lacked the statutory authority to conduct the library district election process. As a result the library district sought an order in the nature of mandamus compelling the Board to include the library district's ballot proposition at the November general election. While the decision resulted in the Board of Election including the library district's budget proposition on the ballot for the 2014 general election, the library district recognized that legislation is necessary to clarify the election process for future elections. This bill is submitted at the request of the Poughkeepsie Library District Board of Trustees.
