Title of bill

An act in relation to authorizing a retired employee of the Chittenango central school district to rescind such employee's retirement option

Purpose

To authorize a retiree that is the victim of a number of violent crimes to receive the maximum single life benefit.

Summary of provisions

Section one identifies the retiree and provides the authority to receive the maximum single life benefit.

Section two is the effective date.

Existing law

Under current law, once a selection is made for a beneficiary to receive benefits from the retirement system, that selection cannot be changed.

Justification

The retiree at issue in this bill selected a beneficiary when married. Years later, that selected beneficiary, to which the retiree was no longer married, committed and was convicted of a number of violent crimes of which the retiree was the victim. But for the selected beneficiary's lack of success when committing these violent crimes, the selected beneficiary would have been precluded from collecting from the retirement system. This legislation provides the retiree with the authorization to remove the convicted selected beneficiary and to receive the maximum single life benefit.
