Title of bill

An act to amend the education law, in relation to foundation aid

Purpose

This bill will include in the 2017-2018 enacted budget foundation aid owed to Brighton Central School District by the State of New York. Specifically, this legislation will create different phase in factors, so Brighton will receive approximately $1 million in Foundation Aid in 2017-2018. Further, the changes in the foundation aid formula will ensure BCSD will be made whole in foundation aid now and in future years.

Summary

This bill amends the Education Law by providing a foundation aid increase for any district of below state average wealth whose foundation aid was reduced through a statewide imposed cap on foundation aid increases in 2007-08.

1: Under the bill, the opening paragraph of subdivision 4 of section 3602 of the education law is amended to make any such district eligible for a foundation aid increase in the 2017-18 school year. Further, this subdivision would exempt any such district from a maximum cap on a foundation aid increase in 2018-19.

2: Under the bill, subclause 9 of clause (ii) of subparagraph two of paragraph b of subdivision 4 is amended to establish a phase-in foundation increase factor that would apply to any impacted school district.

Justification

New York State's foundation aid formula has a fundamental flaw that uniquely and negatively impacts the Brighton Central School District.During the past decade, BCSD has experienced consistent growth and a decrease in their regional wealth yet their foundation aid has been capped at 2008 levels. This bill would rectify this inequity and make BCSD eligible for additional foundation aid.
