Title of bill

An act to authorize Matthew J. McFadden and Richard Gage to elect to participate in the optional twenty-year retirement plan for police officers employed by the village of Avon in the county of Livingston

Purpose

To authorize the Village of Avon in the County of Livingston to offer an optional twenty-year retirement plan pursuant to subdivision (d) of section 384 of the retirement and social security law to police officer Matthew J. McFadden and Richard Gage

Summary of provisions

This bill would permit police officers Matthew J. McFadden and Richard Gage to make application pursuant to section 384(d) of the retirement and social security law, who for reasons not ascribable to their own negligence, failed to make a timely application to participate in such optional twenty-year retirement plan.

Justification

Village of Avon police officers Matthew J. McFadden and Richard Gage, through no fault of their own, did not opt into the special retirement plan offered by the Village. By authorizing the reopening of the plan, these officers will have the opportunity, not previously afforded them, to become members of the special retirement plan, thereby remedying the deficiency.
