Title of bill

An act to amend the education law, in relation to the effect of failed propositions on voter approval for remaining propositions not collectively exceeding the tax levy limit; to amend the general municipal law and the education law, in relation to payments in lieu of taxes; and to amend the education law, in relation to exempting BOCES capital expenditures from limitations upon local school district tax levies

Purpose

The purpose of this legislation is to make several amendments to the property tax cap.

Summary of provisions

Section 1 allows for a school district budget to be subject to a simple majority where the budget itself is tax cap compliant, but voter submitted propositions cause the budget to become out of compliance. Such propositions will be subject to a supermajority for approval;

Sections 2 and 3 include changes in assessed value of payments in lieu of taxes (PILOTs) within the quantity change factor developed by the commissioner of the department of tax and finance;

Sections 4 through 12 exclude BOCES capital expenditures from inclusion in the levy of component school districts; and

Section 13 provides effective dates.

Justification

The property tax cap has proven to be overwhelmingly popular with New Yorkers and has helped to tame the rapid growth of property taxes in this State. These minor amendments to the tax cap are intended to allow it to operate in a more efficient manner and represent common sense changes raised by various advocacy groups. All three changes put forth by this legislation are in response to pointed issues that have arisen during the tax caps first years. Resolving these growing pains will allow the tax cap to continue to provide New Yorkers with needed tax relief for years to come.
