Title of bill

An act to amend the public health law, in relation to the provision of off-site health care services

Purpose

This bill amends the public health law to authorize house calls.

Summary of provisions

Section 1 amends the public health law to allow diagnostic and treatment centers and outpatient clinics of general hospitals to provide house calls, in certain circumstances.

Section 2 - Effective Date

Justification

This bill would allow house calls when a patient in need of professional services available at the diagnostic and treatment center or general hospital outpatient clinic, is unable to go on-site due to a temporary or ongoing medical condition. This will enable patients to more easily access health care visits and avoid the emergency department and/or hospital, consistent with the goals underway to transform health care delivery including preventing unnecessary trips to the hospital.

Additionally, to retain and recruit physicians in rural and underserved communities, many hospitals need to employ them. However, once employed in the hospital outpatient department, physicians are no longer allowed to treat patients in the patients' homes or in nursing homes. This means that elderly, infirmed, and disabled patients must be transported, many by ambulance, to receive routine care. This would allow diagnostic and treatment centers and general hospital outpatient clinics to provide offsite primary care services, in certain circumstances, to patients who are chronically ill and temporarily or permanently homebound at their residence, including those residing in long term care settings that are considered the individual's residence. The bill makes clear that services provided off-site would be limited to those services otherwise authorized to be provided on-site by the diagnostic and treatment center or outpatient clinic.
