Title of bill

An act to amend the public authorities law, in relation to the New York state design and construction corporation act

Purpose

This bill would prevent employees of the Dormitory Authority from being negatively impacted by the creation of its subsidiary, New York State Design and Construction Corporation.

Summary of provisions

Section one specifies the New York State Design and Construction Corporation's oversight over public works as applying to "individual public works."

Section two states that the Dormitory Authority may not lease its own employees to the New York State Design and Construction Corporation.

Section three states that any employee assigned to work at the New York State Design and Construction Corporation shall remain in their collective bargaining unit, and no employee shall receive a reduction in salary or benefits.

Section four removes the New York State Design and Construction Corporation's power to appoint officers and employees from the Dormitory Authority and replaces such power with the power to assign such officers and employees. Section four also removes the New York State Design and Construction Corporation's authority to determine those employees' qualifications, duties and compensation.

Section five removes the New York State Design and Construction Corporation's authority to hire outside contractors for providing services while retaining the authority to hire contractors for advice if the Dormitory Authority does not have such services available.

Justification

This bill would prevent employees of the Dormitory Authority from being negatively impacted by the creation of its subsidiary, New York State Design and Construction Corporation. This Corporation was created in the 2016-2017 Budget and this legislation ensures Dormitory Authority employees assigned to work there have their collective bargaining and other rights protected.
