Title of bill
An act to amend the labor law, in relation to the licensing of persons engaged in the design, construction, inspection, maintenance, alteration, and repair of elevators
Purpose
To amend a chapter of the laws of 2016 relating to requiring the licensing of individuals involved in elevator projects.
Summary of provisions
Section 1:Amends section 954 of the Labor Law, as added by a chapter of the laws of 2016 amending the labor law and the state finance law relating to requiring the licensing of persons engaged in the design, construction, inspection, maintenance, alteration, and repair of elevators and other automated moving people devices, as proposed in legislative bills numbers S.1945-B and A.1787-C, by adding a new subdivision 4 which provides for a restricted license for "Accessibility Technicians."
Section 2:Amends section 955 of the Labor Law, as added by a chapter of the laws of 2016 amending the labor law and the state finance law relating to requiring the licensing of persons engaged in the design, construction, inspection, maintenance, alteration, and repair of elevators and other automated moving people devices, as proposed in legislative bills numbers S.1945-B and A.1787-C, to make technical adjustments and to include the National Association of Elevator Contractors Certified Elevator Technician program within the list of authorized educational programs for those seeking a license as an elevator mechanic.
Section 3:Amends subdivision 1 of section 957 of the Labor Law, as added by a chapter of the laws of 2016 amending the labor law and the state finance law relating to requiring the licensing of persons engaged in the design, construction, inspection, maintenance, alteration, and repair of elevators and other automated moving people devices, as proposed in legislative bills numbers S.1945-B and A.1787-C, to add a representative of the elevator industry association to the elevator safety and standards board.
Section 4:Effective date.
Justification
The use of unsafe and defective elevators and other automated people moving conveyances expose employees and the public to unsafe conditions and create substantial likelihood of serious injury. The improper and uninformed manner in which some contractors and their employees design, construct, inspect, maintain, alter and repair such conveyances creates an unnecessary, and preventable, health and safety risk to employees and the public. The purpose of this bill is to make adjustments to a chapter of the laws of 2016 which provides for the licensing of persons engaged in the design, construction, inspection, maintenance, alteration, and repair of elevators and other automated moving people devices.
