Title of bill

An act to amend the civil service law, in relation to term appointments to temporary positions in information technology

Purpose

Provides for the temporary civil service appointment, without examination, to positions in information technology.

Summary of provisions

Section 1: Adds section 66 to civil service law.

Section 2: Notwithstanding any provision of law to the contrary, the department of civil service may limit certification from the eligible lists associated with titles outlined in this section to those eligible identified as having knowledge, skills or certifications, or any combination thereof, identified by the appointing authority as necessary to perform the duties of certain positions.

Section 3: Adds a new paragraph (e) to subdivision 1 of section 135 of the civil service law.

Section 4: This act shall take effect immediately.

Justification

ITS strives to provide agile, readily deployable, and comprehensive IT services to all executive agencies for which it provides IT services. Due to the rapid pace of technological advancement and customer demands, executive agencies expect ITS to quickly and efficiently build, develop, integrate, or otherwise support new technologies. In many instances, however, the ITS staff have little or no experience in those areas.

Thus in order to satisfy this demand, ITS must either significantly delay these new technology deployments for years to train staff appropriately (with a secondary effect of creating another area of skills need) or engage costly consultants. This bill would allow ITS to recruit into state service middle and high level employees, thereby reducing our reliance on consultants and enriching the state workforce.
