Title of bill

An act to amend the general municipal law, in relation to the premises on which games of chance may be conducted

Purpose or general idea of bill

This legislation would allow games of chance to be conducted on state-owned property.

Summary of specific provisions

Section 1 amends subdivision 13 of section 189 of the general municipal law to allow for games of chance to be conducted on state-owned property.

Section 2 is the effective date.

Justification

Under subdivision 13 of Section 189 the Gaming Commission has interpreted this law to only allow for games of chance on premises of the organization, or on local municipal land, excluding state-owned property from this. The 2016 Brockport Arts Festival Duck Derby was cancelled after the Gaming Authority Deemed the annual duck down the Erie Canal to be in violation of this law. This event serves as the major fundraiser for the Brockport Integrated Service Clubs Organization. Duck races or other similar events are staples of upstate summer festivals for years and have now become outlawed due to this new and overbroad interpretation of this law. This legislation seeks to remedy and bring some common sense back by allowing these events to occur.
