Title of bill

An act to amend the education law, in relation to the apportionment of expenses

Purpose

Requires central high school districts to account for payments in lieu of taxes when determining each elementary district's proportional share.

Summary of provisions

Section 1 amends Section 1908 (1) of the Education Law by requiring the Boards of Education of central high school districts to account for payments in lieu of taxes when determining each elementary district's proportional share.

Section 2 provides the effective date.

Justification

The Valley Stream Central High School District includes three Valley Stream Elementary Districts (13, 24 and 30). Due to a very large PILOT payment that Valley Stream 30 will receive (approximately $14 million), there will be a substantial increase in the proportionate share paid by Valley Stream #24 and Valley Stream 13. There will be a significant reduction in the proportionate share paid by Valley Stream 30.

In the past, PILOT payments were not part of the calculation used in determining proportionate shares due to the payments being of minimal amounts. However, with a substantial amount now being paid to Valley Stream 30, a new formula is needed.
