        AN ACT to amend the penal law, in relation to  creating  an  affirmative
          defense to prostitution
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. The penal law is amended by adding a new section 230.09  to
     2  read as follows:
     3  § 230.09 Prostitution; defense.
     4    In any prosecution under section 230.00 of this article or subdivision
     5  two  of  section  240.37 of this part, it is an affirmative defense that
     6  the defendant's participation in the offense was a  result  of  being  a
     7  victim  of  sex  trafficking  under  section 230.34 of this article or a
     8  victim  of  trafficking  in  persons  under  the   trafficking   victims
     9  protection act (United States Code, Title 22, Chapter 78).
    10    §  2.  This  act shall take effect on the ninetieth day after it shall
    11  have become a law.
