Section 1 of chapter 54 of the laws of 2017, enacting the 2 capital projects budget, is amended by adding thereto the items herein- 3 below set forth in italic and is amended by deleting therefrom the items 4 hereinbelow set forth in brackets as follows: 5 MISCELLANEOUS -- ALL STATE DEPARTMENTS AND AGENCIES 6 NEW YORK STATE SPECIAL INFRASTRUCTURE ACCOUNT 7 CAPITAL PROJECTS - REAPPROPRIATIONS 2017-18 8 NEW YORK STATE SPECIAL INFRASTRUCTURE ACCOUNT (CCP) 9 Capital Projects Funds - Other 10 Dedicated Infrastructure Investment Fund 11 Infrastructure Investment Account 12 Special Infrastructure Purpose 13 The appropriation made by chapter 55, section 1, of the laws of 2016, is 14 hereby amended and reappropriated to read: 15 For services and expenses related to the empire state poverty 16 reduction initiative. Funds appropriated herein shall be made avail- 17 able for sixteen local anti-poverty task forces in municipalities, 18 or a borough, with high rates of poverty as determined by the U.S. 19 Census Bureau's 2010-14 American Community Survey Five-year Esti- 20 mate: Albany, the Bronx, Binghamton, Buffalo, Elmira, Hempstead, EXPLANATION--Matter in italics (underscored) is new; matter in brackets [ ] is old law to be omitted. S. 6314 2 1 Jamestown, Newburgh, Niagara Falls, Oneonta, Oswego, Rochester, 2 Syracuse, Troy, Utica and Watertown. Additional factors that may be 3 considered include high instances of violent crimes, as measured by 4 the division of criminal justice services. Provided that, except in 5 municipalities where a state-funded anti-poverty task force or 6 initiative already exists and is receiving or has received State 7 funding for such purpose, the mayor of each municipality, or in the 8 case of the Bronx, the borough president, will select a not-for-pro- 9 fit organization that provides services in the municipality, or in 10 the case of the Bronx, the borough, to serve as the local coordina- 11 tor of each such local task force. Provided further that, except in 12 municipalities where a state-funded antipoverty task force or initi- 13 ative already exists and is receiving or has received funding, each 14 such taskforce shall make efforts to be comprised of, but not limit- 15 ed to, the following members: representatives from municipal, coun- 16 ty, and/or state government; individuals who have lived in or 17 currently live in households in poverty; individuals and advocates 18 representing local not-for-profit and community organizations; 19 representatives from local school districts; representatives from 20 local law enforcement agencies; and representatives from local 21 social services districts. Of the funds appropriated herein, the 22 amount available for each local anti-poverty task force shall be 23 determined based on the number of people in each municipality, or a 24 borough, who are living in poverty as determined by the U.S. Census 25 Bureau's 2010-14 American Community Survey Five-year Estimate 26 provided that each local anti-poverty task force shall be eligible 27 to receive funding in the following amounts: municipalities with 28 fewer than 5,000 individuals in poverty shall each be eligible to 29 receive $500,000; municipalities with between 5,000 and 10,000 indi- 30 viduals in poverty shall each be eligible to receive $1,000,000; 31 municipalities with between 10,000 and 40,000 individuals in poverty 32 shall each be eligible to receive $1,500,000; and municipalities, or 33 a borough, with more than 40,000 individuals in poverty shall each 34 be eligible to receive $2,750,000. Funds allocated to each task 35 force shall not supplant any funds received under the Edward Byrne 36 memorial justice assistance grant program or federal successor stat- 37 ute. Funds appropriated herein shall be available to support the 38 work of each anti-poverty task force and such work shall be divided 39 into two phases. During the first phase, the mayor of the munici- 40 pality, or in the case of the Bronx, the borough president, will 41 select a not-for-profit organization that has demonstrated success- 42 ful performance working with community stakeholders and achieving 43 objectives specified herein, to coordinate the local antipoverty 44 task force. The not-for-profit organization serving as coordinator 45 will assemble the antipoverty task force using the criteria outlined 46 above. Provided further that, with guidance and oversight of the 47 commissioner of the office of temporary and disability assistance 48 and input from the commissioner of criminal justice services, each 49 local anti-poverty task force shall use data to identify high need 50 issues and neighborhoods within the municipality, or in the case of 51 the Bronx, the borough; identify problems that are common in neigh- 52 borhoods throughout the municipality, or in the case of the Bronx, 53 the borough; receive input from local residents; use data including 54 crime statistics as provided by the division of criminal justice 55 services, and resident input to select one or more focus areas 56 related to either one or more issues or one or more neighborhoods;

S. 6314 3 1 and develop a plan for how funding will be targeted toward the iden- 2 tified issues or neighborhoods. Such focus areas may include, but 3 are not limited to childhood poverty [~~and~~], homelessness gang 4 prevention and intervention and public safety. Activities included 5 in such plan may include, but are not limited to: providing public 6 assistance recipients opportunities to participate in enhanced work 7 activities that either provide recognized credentialing or enhanced 8 career readiness or job training for better linkage to potential 9 employment; assisting families in poverty through services provided 10 to parents and children; and addressing chronic homelessness or 11 housing insecurity. Such plan must include measurable objectives 12 and a timeframe for completion and shall be submitted for approval 13 to the commissioner of the office of temporary and disability 14 assistance. Of the total amount made available to each anti-poverty 15 task force, the lesser of $300,000 or 20 percent of the total award 16 may be used to carry out planning and administration, provided 17 however, that the amount used for planning and administration may 18 exceed such limitation if such amount is approved by the commission- 19 er of the office of temporary and disability assistance as part of 20 the plan required herein. Upon receiving approval from the commis- 21 sioner of the office of temporary and disability assistance, each 22 such anti-poverty task force shall commence the second phase of its 23 work, which will support the implementation of the plan developed 24 during the first phase. Funding appropriated herein shall be made 25 available to the not-for-profit organization serving as coordinator 26 and its use shall be restricted to purposes or initiatives that do 27 not necessitate ongoing state financial support. Such anti-poverty 28 task forces shall be encouraged to secure match funding from private 29 sector and foundation sources to supplement the funds appropriated 30 herein and provided further that any funding provided from this 31 appropriation shall not be used to supplant funding for programs 32 already in existence. Such funds may be made available pursuant to a 33 plan approved by the director of the budget (931A16SP) ... 34 25,000,000 ....................................... (re. $25,000,000) 35 § 2. This act shall take effect immediately; and shall be deemed to 36 have been in full force and effect on the same date and in the same 37 manner as chapter 54 of the laws of 2017 took effect.
