          printed to be committed to the Committee on Insurance
 
        AN ACT to amend the insurance law, in relation to  requiring  that  more
          expansive  Lyme  disease testing be offered as part of most laboratory
          tests covered by health insurance
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Subsection  (i)  of  section 3216 of the insurance law is
     2  amended by adding a new paragraph 34 to read as follows:
     3    (34) For the purposes of this subsection,  whenever  laboratory  tests
     4  shall  be  required  to be covered, such tests shall include testing for
     5  Lyme disease. Coverage shall include at minimum both  the  enzyme-linked
     6  immunosorbent assay (ELISA) and western blot tests, regardless of wheth-
     7  er  they  were conducted consecutively or simultaneously. Coverage shall
     8  not be contingent on such results of either test. Rather, coverage shall
     9  be contingent only on such test having been administered pursuant  to  a
    10  doctor's order.
    11    § 2. This act shall take effect on the one hundred twentieth day after
    12  it  shall have become a law; provided however, that effective immediate-
    13  ly, the addition, amendment, and/or repeal of  any  rule  or  regulation
    14  necessary  for  the implementation of this act on its effective date are
    15  authorized to be made and completed on or before such effective date.
