10 this Flag Day, as our country deals with the
11 senseless acts of violence that have unfolded in
12 our nation's capital this morning, we turn to
13 Father Peter Young, of the Mother Teresa
14 Community, for reflection and prayer.
15 FATHER YOUNG: Thank you, Senator.
16 Dear God, by being a Senator you
17 have been accepted into the leadership position
18 so that you can more fully serve the people of
19 New York State.
20 Today we have heard of the tragedy
21 while looking at TV, having a bit of breakfast,
22 about the bad news about the tragic cost of your
23 position in public service, and into that
24 reality of what now you do to sacrifice for the
25 people of your legislative districts.

1 You represent them, and you do the
2 kind of work that is heroic. May we thank you
3 for that. May we again bless them that have
4 served our country and served in this position
5 of trust. May we again bless them with our
6 prayer.
7 And in that spirit of community,
8 our prayer today will be to better achieve the
9 goal of dedicated representation in the power
10 that is entrusted to all of our legislative
11 leadership. May you attain your satisfaction in
12 services to your constituents. May you always
13 be the example that we now honor and adore.

22 I'm going to ask -- I know we have a
23 busy day here, and there are a lot of people in
24 the chamber, but I'm going to ask that people

3 SENATOR STEWART-COUSINS: Thank
4 you, Mr. President.
5 I just wanted to rise and recognize
6 some very special people in our chamber today.
7 Many times we are standing, all of us, very proud
8 of our heritage and proud of the contributions of
9 the people who followed along the journeys that
10 we have followed.
11 I have often stood up and spoken
12 about my experience as an African-American.
13 Today I stand very proudly as a
14 Caribbean-American whose family on my mother's
15 side came from St. Kitts.
16 New York is actually the home of one
17 of the largest Caribbean immigrant communities,
18 boasting 30 percent of the Caribbean community
19 right here in New York. So it is only fitting
20 that we host this very auspicious delegation of a
21 variety of Caribbean countries right here in
22 New York State.
23 It's also important to note that
24 there are, as far as our count is concerned,
25 about 36 Assemblymembers and Senators who are

1 also of Caribbean ancestry.
2 And we didn't read the whole
3 resolution, but I think it's important to note
4 what is the Caribbean. So we are talking about
5 Antigua and Barbuda; Bahamas; Barbados; Bermuda;
6 British Virgin Islands; the Caribbean
7 Netherlands, also known as the Kingdom of the
8 Netherlands, which includes the countries of
9 Aruba, Curacao, and Saint Maarten; Cuba,
10 Dominica; Dominican Republic; Grenada; Haiti;
11 Jamaica; St. Kitts and Nevis; Saint Lucia, Saint
12 Vincent and the Grenadines; Trinidad and Tobago,
13 Anguilla, Cayman Islands; Guadeloupe; Martinique;
14 Montserrat; Puerto Rico; Saint Barthelemy; Saint
15 Martin; Turks and Caicos Islands; the United
16 States Virgin Islands, including Saint Croix,
17 Saint John, Saint Thomas; and immigrants from the
18 mainland continents of North and South America,
19 including Guyana, Belize, Honduras, Suriname,
20 Costa Rica and Panama.
21 And I think you can tell that many,
22 many places that you've heard of, seen, dreamt
23 about and have traveled to are represented in the
24 Caribbean, and so many of the representatives are
25 here today.

23 I am proud to have the Consul General of Guyana
24 here. We may be on the mainland, but we are
25 Caribbean. And today more than ever, we are one.

2 them all as we celebrate Caribbean heritage.
3 And please come out and enjoy our
4 delicious food this afternoon. For those of you
5 who love to go to the restaurants and buy West
6 Indian-Caribbean food, you will have authentic

8 and enjoy.

15 Mr. President. I also rise to welcome the Consul
16 Generals and diplomats that are here from the
17 Caribbean as well.
18 Many of you don't know, but both of
19 my parents were born and raised in Jamaica,
20 West Indies. They met here and I happened to be
21 born here in America, but I spent many summers in
22 Jamaica. I have had the opportunity to travel
23 throughout the Caribbean.
24 I've never denied my heritage, but I
25 don't have an accent, so I don't try to insult my

1 heritage by using one.
2 But, you know, I understand the
3 beauty and the history of the Caribbean. I
4 understand the pride of our Jamaican heritage.
5 And I've had opportunity to spend summers in
6 Denbigh. My dad was from May Pen, while my
7 mother was from St. Ann's.
8 I had an opportunity to experience
9 both cultures. Living in Jamaica, West Indies,
10 and Jamaica, Queens -- where a lot of Jamaicans
11 came because they thought that they would be in a
12 similar-type environment when they came to
13 New York, only to find out that they were sorely
14 mistaken --
15 (Laughter.)
16 SENATOR COMRIE: -- was a real
17 cultural experience as well.
18 And, you know, I got involved in
19 government because my parents were always
20 involved in helping people transition from
21 Jamaica to New York, to understand how to
22 acculturate themselves, how to, you know, get on
23 a train, how to do the things necessary. And
24 they got me involved in filling out immigration
25 papers at an early age.

1 As soon as I was able to drive, I
2 had to pick them up from the airport and take
3 them from JFK to the Bronx, which is a real
4 cultural shock, for anybody coming from the
5 Caribbean to go to the Bronx or go to Brooklyn.
6 So that got me involved in learning about
7 government from the inside out.
8 So it was my parents that got me
9 started, but it was the richness and history of
10 the Caribbean people that make me understand that
11 we have to take pride in ourselves, we have to
12 respect each other, and we have to be all one as
13 we're working together.
14 So I want to congratulate you and
15 thank you for coming to Albany. I hope that
16 everyone can come to The Well this afternoon and
17 participate and enjoy some of the Caribbean
18 delights. And I hope to have an opportunity to
19 engage with you, and hopefully we're not here
20 until 7 o'clock this evening.

1 In full disclosure, the only island
2 heritage I have was being born on the Island of
3 Manhattan. My parents are from North Carolina,
4 but I represent and I've grown up in a majority
5 Caribbean district in the Northeast Bronx, the
6 36th Senatorial District, which is the
7 Williamsbridge-Wakefield section, one of the most
8 vibrant Caribbean communities in the city, and I
9 would venture to say the country, because White
10 Plains Road is home to some of the best Jamaican
11 restaurants you can ever imagine. We have the
12 best beef patty place in my district, Kingston
13 Bakery -- sorry, Assemblyman Nick Perry, if
14 you're listening.
15 But even being -- not being a member
16 of the -- not having Caribbean heritage, it's
17 very important that we recognize the
18 contributions that you have all made. I go to a
19 Caribbean church, and nobody worships like
20 Caribbeans. I have grown up in a Caribbean
21 neighborhood where they thought that I was
22 Jamaican because my last name was Bailey and it's
23 a common West Indian name.
24 And I really believe that along the
25 same lines as Senator Comrie said, I think that

1 we do more together than apart. If you look at
2 callaloo and you look at collard greens, they're
3 both green vegetables, we just prepare them a
4 little different. The reality is that the unity
5 that we need to have in our communities should
6 persist.
7 And I thank the Consuls General and
8 the diplomats for coming up today, and I echo the
9 sentiments of my colleagues. Come down to The
10 Well if you want some -- I'm not even going to do
11 the accent, Leroy. I was going to say "rice and
12 peas" in a certain kind of way. Come get some
13 great food and enjoy yourselves.

25 I rise today to introduce two guests

1 who have come up from New York City. My guests
2 are Captain Lavonda M. Wise, from the New York
3 City Police Department, as well as Firefighter
4 Jackie-Michelle Martinez, who is with the Fire
5 Department of New York City.
6 And the reason they are here today
7 is because, along with Assemblywoman Jo Anne
8 Simon, I have a bill which will be before the
9 house in the next few days that will change, in
10 New York State, all the agencies, the word
11 "fireman" and "policeman" to "firefighter" and
12 "police officer." It's simple thing, and yet it
13 gives people the recognition that they deserve.
14 There are so many opportunities
15 today for women that actually I never had. At
16 the time, that I could be a teacher, a secretary
17 or a nurse -- I became a teacher. But in today's
18 world, recognizing them by appropriate language
19 is important.
20 And it also reminds me of when
21 Senator Pat McGee, the late Senator Pat McGee,
22 passed legislation that made the New York State
23 constitution gender-neutral. And what this does
24 is make the language in all of our agencies
25 gender-neutral.

1 It's interesting, they were telling
2 us that the first New York City female
3 firefighter was Zaida Gonzalez, and she was in
4 Engine 67, where my chief of staff's father
5 worked. And he remembers hearing about that,
6 that they were the first firehouse to have a
7 woman firefighter in it.
8 But today we have many women in
9 police work as well as firefighters. And the
10 City of Glens Falls has a fire chief who is
11 female, for the first time in their history.
12 So I would like to thank these women
13 for coming up in support of our legislation, and
14 ask all of you to join me in welcoming them.

12 I rise today to honor the life of a
13 dedicated family man who exemplified what it
14 means to be a public servant, someone who was a
15 dear friend of mine and an extraordinary leader
16 in Western New York and New York State: Jim
17 Keane, who passed away unexpectedly late last
18 year.
19 We're joined today by Jim's wife,
20 Margaret; Jim's brother Neil and his wife Ellen;
21 Jim's sisters Mickey Ray and Maureen Sullivan,
22 along with Jim's brother Mike and his wife Marie.
23 They traveled here from Buffalo to
24 be with us as we honor his life and
25 accomplishments, and I want to thank them for

1 joining us.
2 We're also graced by the presence of
3 Jim's extended family member Brother Ed Coughlin,
4 the president of Siena College. Thank you for
5 joining us as well.
6 I wore this shamrock tie here today,
7 Mr. President -- for the first time outside of
8 St. Patrick's Day celebrations -- as an honor to
9 my friend Jim, the consummate Irishman. He could
10 tell a story like no other, read a golf course
11 like a pro -- not to mention interpret those
12 moves for his partners -- and break into an Irish
13 ditty in the blink of an eye. He epitomized what
14 it meant to be South Buffalo Irish.
15 Jim lived and breathed South
16 Buffalo. He was born there, one of 16 children
17 born to Richard and Kate McKenzie Keane.
18 After high school, Jim enlisted in
19 the Air Force and served in the Vietnam War while
20 stationed in Thailand. After he came home, he
21 married the love of his life, Margaret, and began
22 to raise his beautiful family.
23 He got a job at a bank and put
24 himself through night classes at Canisius
25 College. Eventually, after he graduated, Jim and

1 four of his brothers joined the Buffalo Fire
2 Department.
3 Not one to sit back when he saw an
4 injustice, Jim took matters into his own hands
5 and ran for office five years later. He was
6 first elected to the City Council in Buffalo in
7 1977, where he would serve for 10 years as the
8 South District representative.
9 In 1987, Jim threw his hat in the
10 ring for Erie County Executive. But while he
11 came up short in that race, he made a big
12 impression, with the newly elected County
13 Executive Dennis Gorski offering him a position
14 in his administration as Commissioner of
15 Emergency Services. Eventually he was promoted
16 to Deputy County Executive, directing county
17 operations for five years in that role.
18 Jim's work ethic wasn't just known
19 locally. When she was elected to the United
20 States Senate, Hillary Clinton tapped Jim to
21 serve as her Western New York regional director,
22 helping to set up her local office, and advising
23 her on the economic and regional issues that
24 mattered to Buffalo, Western New York, and the
25 entire state.

1 One of the issues that then-Senator
2 Clinton championed was growing the Buffalo
3 Niagara Medical Campus. Back then, it was just
4 Roswell Park Cancer Institute and Buffalo General
5 Hospital. Today, nearly 15,000 people work at
6 the campus, with the addition of the Gates
7 Vascular Institute, the under-construction John
8 R. Oishei Children's Hospital, and the University
9 at Buffalo Medical School. Jim helped set
10 Senator Clinton's local policy, and that impact
11 is visible today.
12 Jim's success in public service is
13 undeniable. But no matter how far he advanced,
14 it all took a back seat to the most important
15 thing in his life, his family. Anytime Jim would
16 talk about Margaret and their four children --
17 Sean, Katie, Jimmy and Meg -- or their seven
18 grandchildren, he would light up like a Christmas
19 tree. He was so proud of what amazing
20 individuals each of them had become, and would
21 rave about each of their successes.
22 Aside from his blood relatives,
23 there was an entire community that considered Jim
24 family, and they his. I am one that considered
25 Jim family. He was my political godfather, the

1 reason I am here today, the one who put me under
2 his wing and passed down decades of knowledge to
3 me as a young aspiring community activist.
4 There are so many individuals --
5 congressmen, Supreme Court judges, senators,
6 assemblymembers, mayors, supervisors, countless
7 Democratic Party faithful -- that would have
8 never achieved their goals without the support,
9 counsel, and direction of Jim Keane.
10 It's also worth noting one of Jim's
11 brothers was Assemblymember Dick Keane, who
12 served nobly in these legislative chambers for
13 over 20 years.
14 Jim was a true man of honor. Once
15 he gave you his word, you could absolutely take
16 it to the bank. Once he gave you his commitment,
17 he was all in.
18 Jimmy Keane had guts, a lot of guts.
19 If he believed in something or someone, even if
20 it was unpopular or against the grain, he'd go to
21 the ends of the earth to deliver. Simply put, he
22 cared about other people.
23 If you ask any elected official in
24 South Buffalo who they aspire to emulate, you'll
25 hear a chorus of the same answer: Jim Keane.

1 He was a man who considered anyone
2 not born in Buffalo to be unlucky, which I think
3 is a sentiment that Jim's whole family can agree
4 with, and I know most in Buffalo agree with.
5 We lost Jim far too early, and the
6 annual Old First Ward St. Patrick's Day Parade
7 just wasn't the same without his joyful presence.
8 I was walking through the crowd as we lined up to
9 march, and I noticed a sea of marchers, all
10 wearing pins with Jim's trademark smile. It was
11 a reminder to me of the impact that this great
12 man had on so many lives in our community.
13 Margaret, Neil, Ellen, Mickey,
14 Maureen, Mike, Marie, and Brother Ed, thank you
15 for sharing Jim with us for so many years. We
16 all miss him terribly. But as much as Jim's loss
17 hurts, we're also comforted in knowing that his
18 legacy lives on throughout our city, our state,
19 and our great nation. We honor him for all that
20 he gave us and thank you for sharing him with us.
21 May Jim Keane rest in peace.

1 Mr. President, I too rise and want to thank
2 Senator Kennedy for this resolution.
3 It was a tremendous loss. And I
4 have gotten to know many of the Keane family over
5 the years, and there's no question -- I hope
6 everybody heard that, there were 16 siblings.
7 That's a lot of people. But I don't think I've
8 ever met a family of that many people that
9 collectively were so integrated into their
10 community or involved in so many things, from
11 churches to schools, community activity,
12 politics, government, Irish Center, you name it.
13 And Jimmy certainly was one of the leaders in
14 that regard.
15 But you know, when you think about
16 it, the lives that he touched, not only in South
17 Buffalo but across Buffalo and all of Western
18 New York, Senator Kennedy hit it right. He did a
19 lot to help a lot of people. And I kind of laugh
20 and chuckle. During his work we may have had an
21 adult beverage from time to time. That's a
22 possibility. And getting to see and know from
23 the inside the dynamics of this awesome family of
24 one of 16, there were many times where I would
25 have to ask Dick, is it okay for me to talk to

1 Jimmy or not? Because there would be a lot of
2 disagreements, sometimes, on what direction.
3 So when you say "had courage" --
4 they would work for a common goal, but each of
5 them were so strong in their own regard, it was
6 really amazing to watch that. But at the end of
7 the day, Jimmy, Dick, Neil, the entire family
8 were always so unified in trying help the folks
9 of Buffalo move forward, and had a great deal of
10 love for this state.
11 I enjoyed my time so much, whether
12 it was trips to Florida, trips to Buffalo, trips
13 to New York City with Jimmy, Dick, the whole
14 family. And certainly I feel honored to have
15 known and been part of my life. And while we're
16 diminished by his passing, I feel enhanced to get
17 to know him and the entire Keane family.
18 So we wish them the best at this
19 time of loss. But know that his good works and
20 memory will live on, for not only your family but
21 many of us for a long time to come. God bless
22 Jimmy Keane. God bless the Keane family.

1 like to thank Senator Kennedy for bringing this
2 resolution before the house today. And my
3 sympathies are with the Keane family.
4 I knew James Keane for almost
5 30 years. And it was very interesting, when I
6 came into the Erie County Legislature as a young
7 man of 34, the county executive was very
8 fortunate to have a deputy county executive by
9 the name of James Keane, because the county
10 executive at the time couldn't get a lot of
11 things done with the legislature. Kind of like
12 what happens here right now, at times.
13 (Laughter.)
14 SENATOR RANZENHOFER: But luckily,
15 he had James P. Keane at his side to help him.
16 So when things had to get done in
17 the legislature, it wasn't the county executive
18 who came across the street to negotiate things,
19 to have conversations, it was the deputy county
20 executive, James Keane, who had a wonderful
21 personality, a wonderful way of dealing with
22 people.
23 You could be at odds on a political
24 issue, but he was someone that you could sit down
25 with, get to the core of the issue that had to be

1 resolved and get it resolved, shake hands, and
2 still be friends at the end of the day.
3 So my memories of him are very fond,
4 they're very deep, and my sympathies are with the
5 family. But he definitely left an indelible mark
6 on the Buffalo community.

19 country -- but certainly the State of New York is
20 defined by those communities that have chosen to
21 make New York their home.
22 I've spoken many times about my
23 adopted home of the Bronx. I'm originally from
24 Puerto Rico. I have many of my brothers and
25 sisters from Puerto Rico there. But I represent

1 more Dominicans than any other state legislator
2 in the country. I have folks that are from the
3 West Indies. Many Caribbean folks that are not
4 in the Northeast Bronx certainly have chosen to
5 come to the Northwest Bronx. It's okay too,
6 there are some folks there too.
7 Some wonderful folks that have
8 joined us here from Honduras, from the Garifuna
9 community, whether we're talking about the
10 Pakistani folks that have sometimes visited us --
11 these are just some of the communities that are

2 some very special guests who have joined us here
3 today. We have Dale Driscoll and Joan Tandle,
4 who are the grandmothers of Brittany Passalacqua,
5 who was brutally murdered, she and her mother,
6 Helen Buchel. And this legislation is actually
7 in memory and honor of those victims, but also
8 for all the victims of domestic violence.
9 We also are joined by Brittany's
10 cousin Corrine LaFlamme and Wayne County Sheriff
11 Barry Virts; Jessica Cassick, domestic violence
12 survivor and author of "Beside Brittany"; and
13 Heather Grimmer, domestic violence survivor.
14 This legislation is so crucial.
15 Unfortunately, we have a wake of victims all
16 across the state. In fact, once every 9 seconds,
17 there is a domestic violence victim somewhere in
18 America.
19 And these bills would be a deterrent
20 because they create a registry of violent
21 offenders, people who have committed domestic
22 violence. And knowledge is power. Having that
23 knowledge makes a difference.
24 And especially in this day and age
25 of social media, of online dating sites,

1 oftentimes people are meeting people online
2 anonymously, they don't know the background.
3 This would be an incredible tool to educate the
4 public about somebody who may be violent and
5 dangerous and end up causing yet another tragedy.
6 I think it's especially ironic that
7 in the City of New York there is an animal abuser
8 registry. And as we know, animal abuse --
9 Senator Tedisco especially knows that animal
10 abuse is a gateway crime to committing violence
11 against people. So if we can create a registry
12 for animal abusers, why can't we create a
13 registry for domestic violence abusers?
14 I want to thank my colleagues for
15 supporting this incredible and important
16 legislation. Senator Helming, Senator Griffo are
17 prime sponsors on it. Many of our colleagues
18 have joined in. They understand how important
19 this legislation is to get done.
20 And I call on the State Assembly to
21 do the right thing. This is the seventh time
22 that this body has passed this legislation. It's
23 time for the Assembly to act, to pass Brittany's
24 Law to protect future victims and to honor the
25 memory of Helen Buchel, Brittany Passalacqua,

11 school is winding up, ending the school year,
12 children are looking forward to going to camp.
13 Unfortunately, we've got a gaping loophole in
14 state law that's putting our children at risk.
15 Right now, under the Public Health
16 Law, we regulate day camps, the traditional day
17 camps, sleep-away camps, travel camps. But
18 unfortunately, we don't have any regulations on
19 the single-purpose camps. These camps have
20 become more and more popular, whether it's
21 focusing on -- whether it's a chess camp or a
22 basketball camp or violin camp, they have no
23 obligation to check their employees against the
24 Sex Offender Registry as well as the Child Abuse
25 Registry.

1 Unfortunately, we're giving parents
2 a false sense of security that their children are
3 safe when they're going to these specialty
4 single-purpose camps. We've got to pass this
5 legislation to close this loophole to make sure
6 we're keeping our children safe, keeping them out
7 of a potential harmful situation.
8 So let's update our laws, make sure
9 we're treating the single-purpose day camps the
10 same as we do the traditional camps, the
11 sleep-away camps, the travel camps, make sure
12 we're giving parents that security, protecting
13 our children and keeping them out of harm's way.
14 Let's pass this legislation, pass it
15 in the Assembly, get it on the Governor's desk,
16 sign it into law to keep our children safe and
17 close this loophole. I'll be voting in the
18 affirmative.

6 passes too many bills for me to stand up on every
7 one. There's a lot of business to do in this
8 house.
9 But I do think it's worth mentioning
10 again today, as I did yesterday, that too
11 frequently, quite frequently, this house puts
12 forward bills that are not sponsored by a member
13 of this house. That creates less accountability,
14 less transparency.
15 And many of these bills seem to be
16 bills that help localities survive from year to
17 year by extending taxes. I don't know if that
18 has anything to do with the decision of which
19 bills Senator Rules is excited about, if Senator
20 Rules has a particular enthusiasm for those bills
21 or if there are members who have a particular
22 lack of enthusiasm for them.
23 We shouldn't be doing it. Senator
24 Rules is not in fact a Senator, despite the long
25 transcripts of my comments suggesting he or she

1 might be a Senator from downstate, upstate, the
2 suburbs, or somewhere in between.
3 We are all Senators. We should
4 introduce bills. We should stand before our
5 constituents who hire us on those bills.

24 SENATOR FLANAGAN: Senator Krueger,
25 I want to be able to explain as adeptly as

1 possible. So if you'll indulge me for a second.
2 Senator Griffo, I want to thank you,
3 not only in serving up there as the leader on the
4 rostrum, but for chairing our Energy Committee.
5 And I would respectfully offer
6 several different thoughts. Number one, I have
7 learned over time -- and again I'm looking at my
8 colleague Senator Montgomery, who I described the
9 other day as a seasoned veteran of the New York
10 State Senate. There are some issues that are
11 really complicated, including energy. And I'm
12 looking at Senator Addabbo. If something is
13 happening in Queens, it has an effect on what
14 happens in Suffolk County, it has an effect on
15 what happens in Senator Phillip's district, and
16 all across the State of New York.
17 So when we hear terms like IPPNY and
18 ISO and ZEC and CES and RGGI -- the first, you
19 know, hundred times I heard RGGI, I always
20 thought of Reggie Jackson, not the greenhouse gas
21 initiative.
22 So what this bill does, I think that
23 it clearly creates a situation where we are not
24 balancing certain things on the backs of
25 ratepayers, plain and simple. And I look across

1 the room -- it could be Senator Ortt, it could be
2 Senator Amedore -- I think what we're doing here
3 is we're saying we want to use existing New York
4 State resources to the advantage of ratepayers
5 all across the State of New York, but we don't do
6 it on their backs.
7 And I had a conversation earlier
8 today -- now I'm looking at Senator Jacobs -- and
9 I don't think I'm going out far afield by saying
10 this. I don't know that there's anyone in this
11 chamber who would get up and say, You know, I got
12 17 calls last week in my office and every one of
13 them was complaining that they felt they were
14 paying too little for energy.
15 So what we are trying to do here is
16 provide efficient, safe, reliable energy and to
17 work with existing programs of the State of
18 New York to balance the equities and the
19 interests between ratepayers and the efficient
20 delivery of energy.
21 ACTING PRESIDENT GRIFFO: Senator

4 explanation, but I'm still a little confused
5 about what specifically this bill does. Could he
6 clarify what it actually does for me?
7 SENATOR FLANAGAN: I believe I just
8 did.
9 SENATOR KRUEGER: Through you,
10 Mr. President, if the sponsor would continue to
11 yield.
12 SENATOR FLANAGAN: Yes.
13 ACTING PRESIDENT GRIFFO: The

15 SENATOR KRUEGER: So he -- the
16 sponsor explained that ratepayers shouldn't have
17 to continue to pay for, I guess, costs of energy
18 through some kind of program. Did he mean
19 specifically that this money would be used
20 instead of the nuclear bailout plan that was put
21 into effect in New York State? Does this bill
22 specifically do away with that program?
23 SENATOR FLANAGAN: Frankly, I don't
24 know what Senator Krueger is referring to.
25 Because if she's aware of some nuclear bailout

1 plan, she has more information than I do.
2 SENATOR KRUEGER: Through you,
3 Mr. President.
4 ACTING PRESIDENT GRIFFO: Senator
5 Krueger.
6 SENATOR KRUEGER: Thank you. To
7 clarify, I believe that there is a contract that
8 the state entered into through the PSC and
9 NYSERDA to guarantee a certain set of payments to
10 three upstate nuclear power plants, and that the
11 cost of these payments would be added to the bill
12 of utility ratepayers. That is the program I'm
13 talking about.
14 Would this bill actually end that
15 contract deal?
16 SENATOR FLANAGAN: Mr. President,
17 through you. What I believe is that this
18 legislation has the first and most important
19 aspect to it of how are we protecting ratepayers
20 across the State of New York. Secondarily, how
21 are we providing efficient, reliable, safe energy
22 in all sectors and all communities across the
23 State of New York.
24 Senator Krueger's reference to a
25 quote, unquote, nuclear bailout plan is certainly

1 a term of art that she has offered. And I don't
2 have to tell you, Mr. President, that you know,
3 as chair of the Energy Committee, that we have an
4 independent entity known as the Public Service
5 Commission who has taken action in the past that
6 deals with a variety of different issues. And
7 I'm just going to use the acronyms again -- ZEC,
8 which is the Zero Emissions Credit. CES, Clean
9 Energy Standards.
10 And does it bear some relation to
11 nuclear power across the State of New York,
12 including four plants in the State of New York --
13 and while three were referenced, there are
14 clearly four -- that provide over 5,000 megawatts
15 of reliable power for ratepayers all across the
16 State of New York, safely, cleanly, and have done
17 so for quite an extensive period. And they do
18 provide thousands of jobs in communities like
19 Senator Ritchie, Senator Helming, and many of our
20 colleagues here in the Senate.
21 SENATOR KRUEGER: Through you,
22 Mr. President, if the sponsor would continue to
23 yield.
24 SENATOR FLANAGAN: Yes.
25 ACTING PRESIDENT GRIFFO: The

2 SENATOR KRUEGER: So as I
3 understand his bill now, he intends to use monies
4 to provide to nuclear energy continuation, but it
5 would not end the contract that the state has
6 gone into providing ratepayer money to these
7 plants. So technically, we will continue to
8 charge ratepayers to subsidize nuclear energy
9 plants upstate, but we will also move additional
10 money into this program. So we will have two
11 different systems to subsidize through, as he
12 describes, the ZCEIP -- I'm not sure how to
13 pronounce it, I'm sorry, that's why I spelled it
14 out, the Zero Carbon Emission Investment
15 Program -- to subsidize nuclear power plant
16 operations.
17 So we will have two different
18 funding streams underwriting and subsidizing
19 nuclear power, is that correct?
20 SENATOR FLANAGAN: No.
21 SENATOR KRUEGER: Through you,
22 Mr. President. Could the sponsor explain how the
23 answer is no? Since he had just answered that
24 this doesn't change the existing program where
25 ratepayers are subsidizing nuclear energy, and

1 he's describing his own bill creating a new
2 program to subsidize nuclear power plant
3 operations. So how is it not the one we have
4 plus his?
5 SENATOR FLANAGAN: So I --
6 Mr. President, through you, I'll just make a
7 couple of different references.
8 Number one, every person I have
9 spoken to in our conference has talked about
10 these issues. Whether it's hydropower or NYPA or
11 NYSERDA or whatever it may be -- and going back
12 to my veiled reference before about RGGI, all of
13 these things are interrelated.
14 Page 2, line 48, speaks very clearly
15 that the actions that have been implemented by
16 the Public Service Commission shall be deemed
17 null and void. Why do we do that? That's to
18 protect the ratepayers.
19 Why do we advocate for utilization
20 of resources from other pots of money, including
21 NYSERDA in particular? Because we feel that
22 state resources should be there to help
23 facilitate, again, the efficient delivery of
24 energy at affordable rates for people all across
25 the State of New York.

1 Now I'm going to personalize it.
2 And I think I may have said this before. My
3 mother, thank goodness, is quite healthy and
4 doing well. And it's very rare when my mother
5 speaks to me about government or legislation.
6 She'd much rather talk about my three kids and
7 her 13 grandchildren and dwell on those types of
8 things. So I know, like Senator Avella, Senator
9 Parker, Senator Gianaris, if your mom gets on the
10 phone and talks to you about her utility bill,
11 you'd better pay attention. Serrano, that goes
12 for you too, Senator Serrano.
13 So these are things that I think
14 about. And I look at my colleagues who pay
15 attention to all of these issues. We're talking,
16 again, about the proper, reliable, safe delivery
17 of service. And I don't believe that these types
18 of things should be saddled on the backs of
19 ratepayers. If we can do it within existing
20 programs and resources of the State of New York,
21 that would be a wiser course of action.

20 of the sponsor's bill says the act shall take
21 effect immediately, and upon enactment, the Zero
22 Emission Credit as part of the Clean Energy
23 Standard as implemented by the Public Service
24 Commission shall be deemed null and void.
25 Hence it would be ending the

1 existing arrangement the state had already moved
2 forward that has ratepayers subsidizing nuclear
3 power plants, and that he intends this bill to
4 replace that.
5 That was what I asked earlier. I'm
6 just spelling it out in the context of the bill.
7 I believe the answer is yes, but I want to make
8 sure the sponsor agrees with me.
9 SENATOR FLANAGAN: So we may be
10 looking at it through a different prism or
11 perhaps even a set of rose-colored glasses. This
12 is what I understand.
13 My colleague right here to my right
14 literally -- not always politically, but
15 literally to my right -- is an ardent advocate
16 and environmentalist and cares very deeply about
17 clean energy, reliable energy, safe energy. And
18 more importantly than anything else, he cares
19 about his constituents and ratepayers.
20 Essentially what we're doing is
21 saying that we don't agree with the Public
22 Service Commission that this should be laid on
23 the backs of ratepayers the way they want to do
24 it. We choose a different vehicle. And every
25 one of us believes that we want to have plants

1 that are operational, that are efficient. And
2 whether they're overseen by the PSC or FERC or
3 NYSERDA or NYPA, whatever the entity may be, I
4 don't think any one of us has a problem with
5 appropriate regulation.
6 I'm going right, right to the core
7 of what this is. We are talking about
8 ratepayers, plain and simple. We choose a
9 different vehicle, and we want to take some of
10 the monkey off their back.
11 SENATOR KRUEGER: Through you,
12 Mr. President, if the sponsor would continue to

24 utilizing funding within existing resources,
25 which ties directly to zero emissions, full well

1 knowing that the advocacy that we are doing is
2 not only safe, but it provides the lowest
3 nonexistent level of emission credits compared to
4 any other form of energy.

14 detailed memo that I have from our crack staff.
15 So to a degree, we rely on the
16 people that we work with. I have great faith in
17 the people that I work with and associate with,
18 not only as members but from our staff. And I
19 know you've sat through probably at this point
20 1500, 2,000 hours of testimony at Finance
21 hearings.
22 I'm just going to tell you that I
23 work with people who I have great faith in their
24 expertise, and the number I gave you was off, for
25 which I apologize; $2.86 billion is the number

1 over 12 years. And I'm sorry for having made
2 that mistake.
3 SENATOR KRUEGER: We all make
4 mistakes, Mr. President. I appreciate that.

17 not going to disagree with what she may be
18 advocating.
19 But, you know, when we talk about
20 clean energy, what I'm advocating is absolutely
21 100 percent related to clean energy.

2 Does the sponsor know that there are
3 3384 people in his own district who work in the
4 clean energy industry thanks to the existing
5 programs we have put in place in New York State?

9 In total, the estimate is that there
10 are 85,000 jobs in clean energy in the State of
11 New York. That's a lot of jobs. And these jobs
12 have been created and funded and supported by the
13 NYSERDA Clean Energy Fund Program distribution.
14 Since the revenue source for the
15 sponsor's bill before us tonight would be these
16 same funds, does the sponsor have any concern
17 that by prioritizing nuclear energy subsidy, we
18 are actually cutting off our nose to spite our
19 face and resulting in --

21 SENATOR KRUEGER: I'm sorry, is
22 that one of us? No.

11 all concerned that we will be shifting money from
12 successful energy efficiency/clean energy
13 programs and shifting that money into nuclear
14 plant subsidies, resulting in not just the loss
15 of jobs but the lost potential of more and more
16 new jobs in energy-efficient renewable energy
17 sources?
18 SENATOR FLANAGAN: No, I don't
19 share that concern whatsoever. We can
20 absolutely, without hesitation, do both.
21 SENATOR KRUEGER: Through you,
22 Mr. President, does the sponsor have a same-as in
23 the Assembly?
24 SENATOR FLANAGAN: No.
25 SENATOR KRUEGER: On the bill,

1 Mr. President.

3 Krueger on the bill.
4 SENATOR KRUEGER: I want to thank
5 the sponsor for his explanation.
6 Here's the problem. I'm not a big
7 fan of the ratepayer subsidy system PSC put in
8 place and that it does bill the ratepayers.
9 But in fact I was under the
10 impression it was going to be $7 billion over
11 12 years. And if the sponsor's correct and it's
12 less than $3 billion over 12 years, the actual
13 cost per ratepayer plummets dramatically -- I
14 mean, just roundly, at least in half.
15 So I've had good news tonight;
16 ratepayers actually are going to pay a much
17 smaller sum to the existing PSC nuclear plant
18 bailout if in fact my colleague is correct. So
19 that's good news, and we didn't even get a bill
20 passed, that we actually suddenly are going to be
21 paying much less than I was led to believe by PSC
22 would be the cost. So that's good news.
23 And yet the way we're going to pay
24 for the sponsor's legislation is to take money
25 that is being so effective and successful now in

1 creating a renewable energy/clean energy system
2 in New York State that is putting us ahead of
3 most states in the nation to get to our targets
4 of moving off of fossil fuels, lowering
5 emissions, and having a 21st-century model of
6 energy production.
7 So my concern is, how do you
8 prioritize? And to take it away from these
9 programs that are being incredibly successful --
10 and I have memos from so many organizations
11 verifying how effective the existing program is
12 and how much harm would be done in job killing
13 and loss of not just the momentum we have, but
14 actual loss of jobs that exist in every single
15 district in our state.
16 And again, there are studies that
17 have been done -- Clean Jobs New York, May
18 2016 -- statistics that break down by county the
19 number of clean-energy jobs created under the
20 existing programs. And by the way, the map
21 highlights where the greatest number of jobs are,
22 and in fact it's Long Island that has the
23 greatest number of jobs created by the existing
24 clean-energy programs through NYSERDA.
25 So I'm not sure how many jobs would

1 be created to replace those lost jobs on
2 Long Island, but I don't think they have a
3 nuclear power plant. I'm not sure if they want
4 one, but I don't think -- there's no nuclear
5 power plant on Long Island -- they're still
6 closing for one that didn't open, thank you. But
7 there is none.
8 So we would see a shift of who the
9 money went to and a real loss in jobs in very
10 specific areas of the state. And I think that is
11 a greater penalty, not just for the ratepayers
12 but for the future of clean energy in New York
13 State, the potential that we are speeding towards
14 of having an efficient, renewable, less costly
15 system throughout New York State.
16 But mostly I just want to close with
17 my arguments against this bill and urge a no vote
18 because a different system to subsidize nuclear
19 than we've already put in place may save the
20 ratepayers some money -- a lot less money to be
21 saved than I had thought, because it's less
22 costly than I knew. But it translates into
23 thousands and thousands and thousands of jobs
24 that will be lost throughout the State of
25 New York without expansion of these same programs

1 that would create more jobs.
2 For what? Are we getting new jobs
3 in nuclear energy? I'm quite sure we're not.
4 I'm quite sure we're not building new nuclear
5 power plants.
6 And so I think it's a bad priority
7 system, Mr. President. I think there are more
8 losers than winners. And I think we would be
9 making a terrible mistake for the State of
10 New York if we were to pass this into law.
11 Another good news is it's very late
12 in the session year, there is not a same-as bill
13 in the Assembly, so we're just having a chat
14 among friends. And I'm quite sure that the
15 Governor is not interested in having a reversal
16 of all of his clean energy programs and
17 commitments.
18 And yet I would still urge my
19 colleagues on both sides of the aisle to say no
20 to this bill. There's so many good things we can
21 do going forward to move into even a greater zero
22 emissions set of goals -- off of fossil fuels,
23 job creations in green energy. Again, the
24 potential in this state is enormous for enormous
25 numbers of new jobs in a growing green economy.

2 I urge a no, Mr. President, and I

11 I've had the honor and privilege to serve the
12 people of the 21st Senatorial District in
13 Brooklyn -- which, you may be familiar with, is
14 Flatbush and East Flatbush, Midwood, Ditmas Park,
15 Windsor Terrace, and Park Slope -- I have spent
16 that entire time either as the chair or as the
17 ranking member on the Energy Committee. And over
18 the last few years I've had the great honor of
19 serving alongside the chair of the committee,
20 Senator Griffo, who we worked very well together
21 on a lot of really important issues as relates to
22 energy in this state.
23 I think that I agree with the
24 sponsor of the bill that Senator Flanagan is
25 absolutely right about the impact on ratepayers,

1 he's totally right about the need to really deal
2 with and take care of these nuclear power plants.
3 But we should understand the context
4 that we're being put into. Right? It's just not
5 a matter of here are a bunch of nuclear power
6 plants, they're having a hard time, let's bail
7 them out. This is not a willy-nilly bailout of
8 nuclear power plants.
9 An emergency has been created
10 because of the closing of Indian Point Nuclear
11 Power Plant. And because of that dynamic, which
12 in fact closes -- actually ends about 20 percent
13 of the power in the region -- not just in the
14 State of New York, but you're talking about
15 New York, Pennsylvania, Connecticut, I think even
16 Massachusetts gets some of that power -- and has
17 created a dynamic where we, down the line, will
18 have a significant issue as it relates to, you
19 know, demand and actually meeting the demand of
20 our communities.
21 Not to mention, if we allow these
22 power plants to go out of business, the loss of
23 jobs, the real estate revenue, tax revenue from
24 real estate, and other catastrophic impacts
25 around the state that will be caused if in fact

1 these power plants are allowed to fail.
2 I spoke at an energy conference this
3 morning in Boston and talked about the fact that
4 those of us who believe in and understand climate
5 change are at war. Literally. Literally. We're
6 literally talking about the future of the planet.
7 And unfortunately, we have allowed the federal
8 government to be captured by people who are
9 climate change deniers. And because of such,
10 there are now a series of policies in motion that
11 are in fact eroding the work that has been done
12 over time to build up our renewable energy
13 portfolios.
14 New York was lucky to be at the
15 forefront of this movement and the creation of
16 what you heard Senator Flanagan talk about as
17 being RGGI, the Regional Greenhouse Gas
18 Initiative. It's a cap-and-trade program on
19 utilities in a number of states, including
20 New York and Massachusetts, in which we cap the
21 amount of carbon being produced in those
22 utilities, and then that money goes into a fund
23 that is then used to produce alternative energy.
24 Everybody with me?
25 So what this particular bill is

1 attempting to do is to say we have an emergency
2 because of Indian Point, so we can't afford to
3 let these other nuclear power plants go out of
4 business because we'll have a demand problem,
5 we'll have an employment problem, we'll have a
6 tax revenue problem. We can't -- they're too big
7 to fail at this point.
8 And so the Governor, in his wisdom,
9 created what they call a ZEC, a zero carbon
10 emission program, right, in which he's
11 essentially using general funds to fund that.
12 Why is he doing that? Because the RGGI funds are
13 used for alternative energy -- I'm sorry,
14 renewable energy. Right?
15 And this is the point of departure
16 with me and Senator Flanagan, is that nuclear
17 power is not a renewable resource. And it's
18 not -- it's not -- and although, you know,
19 they're calling a ZEC a zero carbon emissions,
20 and that's technically right, but this is far
21 more art than -- this is definitely let me call
22 it -- this is poetry, not prose. Right? In that
23 although it's zero emissions, it's not renewable,
24 in that there still is waste that's produced,
25 it's just not emissions. Right?

1 So that's why you have to
2 decommission a nuclear power plant, you just
3 can't simply close it. Right? Because there is
4 waste that's produced, and very significant waste
5 that is produced. Right? It's just not
6 emissions.
7 And so, yeah, it's zero carbon
8 emissions, but there's still waste. And so RGGI
9 is supposed to be renewable, and renewable means
10 not just zero emissions, but also zero waste.
11 And so where I agree that we ought
12 to be finding better ways to help New Yorkers
13 around the state bear the burden of high energy
14 costs, which is important not just for
15 residential taxpayers, but also becomes a burden
16 on small businesses throughout the state -- and
17 becomes an obstacle to both keeping businesses
18 running optimally throughout the State of
19 New York but also keeping us from attracting
20 them -- I think that we have to find a different
21 mechanism.
22 I am more than hesitant to raid
23 RGGI, the Regional Greenhouse Gas Initiative
24 funds, in order to use it for this particular
25 program. Although I do agree with the motives of

1 the sponsor, and certainly would be interested in
2 working with him and others on trying to find
3 other ways that we could do it.
4 I think even if we used the systems
5 benefits charge -- the systems benefits charge
6 money also goes to NYSERDA, the New York State
7 Energy Research and Development Authority, and
8 the system benefits charge is money -- you know,
9 we all pay it, it's actually in your gas bill and
10 your electric bill and is actually stored at
11 NYSERDA.
12 We certainly, I think, could use
13 that money. That money I think would be
14 appropriate. I don't know if we could do a
15 hundred percent one-to-one match. I don't know
16 exactly the dollar amount. But I think that that
17 would be a more appropriate use of money that's
18 located in NYSERDA.
19 But the RGGI funds really ought to
20 be used for things like we did. When we were in
21 the majority in 2009, we passed the Green Collar
22 Jobs Bill. What did that bill do? And I was
23 happy to be the author of that bill, along with
24 Senator Darryl Aubertine at the time.
25 The bill took $113 million from RGGI

1 and retrofitted a million homes over five years.
2 Right? The impact was threefold. Remember, I
3 talked the other day about externalities? You
4 all want me to go back to that lesson, or no?
5 All right, no. Okay, you got that. Has
6 everybody got their notes?
7 So when we talk about the
8 externalities of doing a project like that, there
9 was actually three things that happened
10 initially. This is actually the first layer.
11 Right? Lowered the heating bills of those
12 million homes that were retrofitted. Created
13 jobs, two. And three, lowered our carbon
14 footprint.
15 Because when you're retrofitting
16 homes and you're making them sealed better --
17 right? Most people here -- when you go home,
18 most of us, unless you've had your house recently
19 retrofitted, we have the equivalent, in terms of
20 cracks and things that are not sealed, of an open
21 window in our homes. And that becomes obviously
22 a problem in the winter when we're trying to keep
23 the house warm, but also a problem in the summer
24 when we're trying to keep the house cool. So you
25 really want your house as air-tight as possible.

1 And NYSERDA actually has a number of
2 really wonderful programs to help you do that,
3 and I suggest that people both look at it for
4 themselves but also make sure that your
5 constituencies avail themselves of these
6 wonderful programs that are means-tested and give
7 you great tax benefits to actually do this work.
8 But I thought that that project was
9 a wonderful use of RGGI funds. We should
10 actually do a Green Collar Jobs II. I happen to
11 have a bill, if Senator Flanagan is interested in
12 bringing it to the floor.
13 But I think on this particular case,
14 that this use of RGGI funds is not the right use,
15 and so unfortunately I'll be voting nay.
