15 Mr. President.
16 I rise to speak on this
17 resolution -- that both Senator Tedisco and I
18 sponsor -- congratulating the Shenendehowa
19 High School Varsity Swimming and Diving Team and
20 their head coach, Chuck Dunham, on being ranked
21 No. 1 in New York State by the National
22 Interscholastic Swim Coaches Association. Once
23 again, the outstanding student athletes at
24 Shenendehowa are number one.
25 We are honored to have the team

1 members and their coach, Chuck Dunham, with us
2 today as our special guests.
3 The Plainsmen Swimming and Diving
4 Team were ranked number one out of 22 schools in
5 our state by the National Interscholastic Swim
6 Coaches Association in the large school category.
7 The Plainsmen ended their season with an
8 impressive undefeated 11-0 record, including
9 winning the Section II Division 1 Swimming and
10 Diving Championship. They scored 503 points to
11 beat the Bethlehem High School Boys Swimming and
12 Diving Team by an impressive 151-point margin,
13 and they beat the Long Island Swim Coaches
14 Association champions with an impressive
15 554 points in Nassau.
16 Swimming and diving require
17 incredible commitment and dedication. They are
18 skilled sports that demand stamina and strength,
19 power and precision. These incredible student
20 athletes spent countless hours in the pool
21 training, pushing themselves to the limit,
22 working towards perfection in and out of season.
23 The hours of tough practices and
24 sacrifices you made for the Plainsmen
25 championship have resulted in the Plainsmen

1 championship undefeated season. Congratulations
2 again on a job well done. You have made your
3 school, your community, and your families very
4 proud.
5 I'd ask that you call on Senator
6 Tedisco, please.

9 SENATOR TEDISCO: Thank you,
10 Mr. President. And thank you, Senator Marchione.
11 It's always exciting for me, and I
12 know the Senator, and we're always honored and
13 it's a tremendous pleasure for us to bring in the
14 outstanding students and student athletes, those
15 who participate in activities and athletic events
16 from the 43rd Senate District and the 49th Senate
17 District. Because we like to say all good things
18 emanate from those Senate districts, and they
19 just happen to be our Senate districts.
20 Now, by way of full disclosure -- I
21 think I told you a little bit about this, but I
22 was a teacher and athletic coach, coached the
23 Varsity Basketball Team at Bethlehem Central. I
24 don't hold that against you, because you're my
25 team because you're in my district now.

1 And I can't tell you how proud we
2 are. It just is phenomenal, the number of
3 individual students and their achievements over
4 the year that I've been here, the six months, or
5 in the Assembly, and the activities and the team
6 groups that have achieved -- well, not exactly
7 what you've achieved all the time, but a
8 tremendous amount of success in a whole variety
9 of areas.
10 And for those who are not
11 swimmers -- and I'm not a swimmer, I played
12 basketball, I coached basketball, was involved
13 with the sport of basketball. But I had a little
14 experience with swimming, and I told them about
15 that experience.
16 I went to Union College in
17 Schenectady, New York. And a great academic
18 school. The school is over 200 years old, a
19 great liberal arts school. I found out as a
20 freshman I had to be able to learn to swim before
21 I could graduate, even if I had a complete 4.0.
22 So I had to get up 7, 8 o'clock in
23 the morning. And the athletic director, with my
24 fellow roommate -- because he couldn't swim
25 either -- had to go to the pool in the morning,

1 he had to teach us how to swim. Now, I could
2 learn, and I did learn how to swim. He never
3 learned how to swim. Couldn't do it, couldn't
4 see in the pool because he had big Coke-bottle
5 glasses.
6 But I can tell you this. If you
7 haven't ever swam before, two or three laps up
8 and down the pool, you're going to find out
9 you're pretty well winded. It's not just what
10 some people think, you jump into a pool, oh, do a
11 few laps, or you go out there, dive a few times,
12 you're an expert diver. This takes a tremendous
13 amount of effort, hard work, tremendous work
14 ethic. And it takes outstanding coaching.
15 And along with these outstanding
16 four students, student athletes and swimmers --
17 who are going, by the way, be the core. I think
18 there was 35 members all together. About 31 now,
19 I guess, are taking Regents. These are the
20 juniors. They'll be back next year, and they'll
21 be the particular core of the team.
22 But it takes tremendous coaching
23 also to get those students out there to make sure
24 they're going through the steps necessary to be
25 in shape to win those races.

1 But most importantly -- and I heard
2 the coach say this -- he takes a team approach.
3 It's not just about individuals. And I think the
4 reason why this team is so successful, as I see
5 them, as I see their records, you don't win every
6 event and you don't become the championship
7 diver, the championship Section II team, unless
8 the coach has taught you the number-one most
9 important thing you should know -- probably the
10 number-one most important thing we should have
11 learned here as public servants who represent our
12 constituents.
13 That as individuals, if they didn't
14 care who got the credit, they and the team
15 themselves could achieve unbelievable success and
16 goals. That will serve you well throughout your
17 entire life, because every part of your life is a
18 team. Got Democrats on that side, Republicans on
19 this side. We saw what happened in Washington.
20 Hopefully that strikes a chord. Hopefully we
21 understand we have to be a team. We can
22 disagree, but we can disagree in the right way.
23 You guys you were a team that
24 understood individually, if you didn't care who
25 got the credit, the entire team could achieve the

1 successes that you've achieved.
2 I just want to say this about the
3 coach. Under his leadership, Coach Chuck Dunham,
4 the Boys Swimming Team and Diving Team has a meet
5 record of 114 wins and only three losses. Coach,
6 you're doing your job, and it's going to suit
7 these guys well. With their families, as they go
8 on with their education, with any other job they
9 undertake, that's going to be another team.
10 You've taught them to understand their role,
11 fulfilling their role in that team to make the
12 success that has come about.
13 So I just want to say phenomenal
14 record, but this is just the beginning of a lot
15 more important successes you're going to have in
16 the future because of what you're learning in
17 that pool along with your teammates, along with
18 your coach. So congratulations.
19 Mr. President and my colleagues, can
20 we welcome them and offer them all the
21 cordialities for this phenomenal success and what
22 bodes well for their future and our future
23 hopefully still in New York State.

17 So on its face, this appears to be a
18 bill that would simply allow volunteer fire and
19 ambulance departments to slightly expand and
20 streamline the way they use lotteries to collect
21 money for themselves.
22 But in fact when you read the bill
23 carefully, you understand that it actually
24 expands onto a much larger platform -- the
25 Internet -- an ability for anyone and everyone to

1 choose to participate via computer and credit
2 cards and other forms of tender in lotteries that
3 can grow in enormous size and be actually another
4 form of online gambling in the State of New York.
5 And its definition of what
6 charitable organizations could participate is
7 actually broad enough that you can see for-profit
8 people going into the business of helping the
9 not-for-profits run the online lottery. And I
10 think it's just really just back-door unlicensed
11 online gaming in this state.
12 So I think even those people who in
13 good faith believe this is a small help to one
14 small universe need to think through how it's a
15 much, much bigger potential impact statewide that
16 could impact all 19.5 million of us.

2 to point out that the reason for this piece of
3 legislation that relates to exempting tension
4 pneumothorax decompression needles from criminal
5 possession of hypodermic instruments is a
6 recognition that still on our books is a law that
7 makes it illegal to carry hypodermic instruments.
8 And so as we're talking on this
9 floor many, many times -- and we've done it over
10 the last couple of weeks; I'm sure that we'll do
11 so over the next couple of days -- about the
12 scourge of the opioid epidemic and the fact that,
13 as we've acknowledged, it is a public health
14 issue and acknowledged further that harm
15 reduction is something that works, needle
16 exchanges is something that works to make sure
17 that we can treat people with addiction -- the
18 fact that people that are in these programs still
19 have to worry about the fact that there is
20 something on the books which makes it a crime to
21 carry hypodermic needles is a problem.
22 I just want to say that it's a
23 little hypocritical that we are doing this --
24 certainly this is a worthy exemption, but I
25 believe that we should not have to do an

1 exemption, that we should change the law so that
2 people that have hypodermic needles, particularly
3 those folks who are struggling with addiction,
4 are not found to be criminal only because they
5 have these in their possession, they have clean
6 needles in their possession, therefore dealing
7 with the further health issues that might happen
8 if they have to use dirty needles.
9 So I will be voting in the
10 affirmative, Mr. President, but I just wanted to
11 point that out. Thank you.

4 diploma is the right thing to do. And I urge you

7 putting on the agenda and fighting for creating
8 an alternative pathway to a diploma. We're
9 leaving really good kids behind with a
10 one-size-fits-all testing system.

22 So when we passed the minimum wage
23 increase law in New York State, we did in fact
24 attach a tax credit formula to it for certain
25 people. A lot of us didn't like it then. And

1 the reason we didn't like it was it was actually
2 going to be setting up a scenario where employers
3 might hire young people to keep them at minimum
4 wage, because if they went 10 cents over the
5 minimum wage they would lose the subsidy from the
6 state. So we'd be trapping people in perpetual
7 minimum wage. But that was for youth.
8 Now, with this bill, it would expand
9 it to all age workers that as long as you're at
10 minimum wage, the state will provide the employer
11 a subsidy. Hence, the employer would have no
12 motivation to ever go above minimum wage no
13 matter how good a worker you are or how long you
14 worked there.
15 But to add to the problem with this
16 bill, it defines it if you're a seasonal worker.
17 Well, a seasonal worker simply means for 90 days
18 or less. So if I'm an employer, I might very
19 well take a look at and say, Let's make my year
20 up out of X number of 90-day seasons -- a holiday
21 season, a summer season, a spring season, an
22 equinox season, whatever kind of season I want,
23 as long as it's 90 days or less -- and continue
24 to roll over my labor so that I can keep getting
25 a government subsidy of my wages as long as I'm

1 never paying anybody over minimum wage.
2 I think it's really dangerous labor
3 policy.
4 It also, I believe, has a price tag
5 of $205 million, which so clearly it ought to be
6 discussed in the context of the budget. But if
7 it was in the budget, I would have to argue
8 against it for the reasons that it's bad labor
9 policy.
10 So I'm hoping people understand the
11 big-picture impact of this bill and join me in
12 voting no, Mr. President. Thank you.

18 version of this law that I believe was carried by
19 Senator Zeldin originally, from Long Island,
20 actually clarified that a spear fisherman had to
21 be X distance away from a shoreline.
22 And he put that into the bill
23 because I raised a concern with him that children
24 and adults could be swimming along a shoreline
25 and, underwater, a spear fisherman might not know

1 the difference between a child or small person
2 swimming by and a large fish.
3 And so if this bill had a standard
4 of how far away you had to be from the shoreline
5 before you used the spear for spear hunting --
6 spearfishing, I don't think I would have a
7 problem. But as it is today, I do, so I vote no.

4 Let me thank Senator Lanza for his
5 leadership again on this important issue of
6 dealing with gangs. In New York City, we have
7 been overrun -- and almost in the whole country.
8 And I really believe that really has to do with a
9 lot of our disinvestment in public education, our
10 disinvestment in school-based athletics, our
11 disinvestment in after-schools programs, and the
12 lack of attention that we have paid our young
13 people, far more than the issue of adjudication.
14 And so although I agree with the
15 intent of this bill, I unfortunately can't vote
16 for it, because I don't think that it takes us in
17 the right direction.
18 I certainly would almost be more
19 willing to vote for bills like this if in fact,
20 despite lip service to addressing the issues of
21 our young people, that we brought more bills
22 forward that started to deal with some of the
23 issues that our young people are having. And I
24 think that would both deal with some of the
25 things around gang violence as well as the things

1 that we're dealing with in terms of opioid
2 addiction and other plagues that are harming our
3 great state.

15 I rise today in support of this
16 important legislation. It will further protect
17 our children by increasing penalties for
18 overtaking a school bus.
19 Our children are precious, and
20 protecting them should be our utmost priority.
21 Each school day, millions of parents watch as
22 they send their children off to school, fully
23 confident that their kids are safe.
24 Unfortunately, oftentimes they're not.
25 One estimate says that 50,000

1 drivers in New York illegally pass a school bus
2 each day. That's 50,000 people who put the lives
3 of our children at risk. And to make matters
4 worse, many of these drivers are repeat
5 offenders, blatantly ignoring the law.
6 Current law for a third repeat
7 violation only allows for fines up to $1,000 and
8 six months in jail. By passing this bill today,
9 we'll increase these penalties to up to $2,000
10 and a potential prison term of one year.
11 And for those drivers who pass a
12 school bus and hit and kill a child under 15,
13 this bill will create the crime of vehicular
14 manslaughter in the third degree, enhancing
15 penalties above where they are today, up to four
16 years in prison.
17 Our actions in the Senate today send
18 a message that those who continue to flagrantly
19 ignore signs to stop, and those who put our
20 children at risk, will be brought to justice.
21 This ignorant vehicular action that endangers our
22 youth will not be tolerated in New York.
23 Let me be clear. If you repeatedly
24 and egregiously choose to violate the law and
25 jeopardize the safety of our children, you can

1 expect to pay up and spend time where you
2 belong -- off the streets and behind bars.
3 And we need to remind the millions
4 of drivers on the roads each day to remember to
5 watch for children getting on and off buses:
6 Follow the law, and stop when a bus is stopped
7 and the lights are flashing. It's very simple.

12 people to vote against this bill, so I just want
13 to explain why I am voting against this bill.
14 One, we know several things are
15 facts. We know that we have a shortage of
16 substance abuse treatment slots in the State of
17 New York. I am in fact having a meeting soon
18 after session is over with OASAS to figure out
19 why the hell we can't get them when people ask
20 for them in the City of New York.
21 And so you hold that up, we are
22 desperate for additional treatment slots, and
23 then you listen to the experts who submit memos
24 explaining that they don't believe that forced
25 treatment is actually successful -- can do harm,

1 but clearly is using up resources needed in the
2 community by people who are at the point where
3 they are prepared and willing to go into
4 treatment.
5 So I have to oppose this bill
6 because I don't think we can afford to take
7 desperately needed slots away from those who are
8 ready, willing and able to participate in
9 treatment in order to make people go into
10 treatment when they're not ready and the research
11 shows it will not be successful, statistically.
12 Perhaps if we had unlimited
13 resources for substance abuse treatment and we
14 had endless slots available, we could talk about
15 trying this with people who are reticent. But
16 I --

16 You know, for law enforcement and
17 for the men and women of our intelligence
18 community, trying to prevent the next attack is a
19 grand puzzle, putting together pieces from all
20 over. As we saw in the cases in France and the
21 recent terrorist attacks in the United Kingdom
22 and our own country -- in San Bernardino, and the
23 Boston bombing -- what we've seen is every piece
24 of data that we can give law enforcement, every
25 piece of data that we can give our intelligence

1 community gives us an increased chance of
2 providing predictive analysis to the men and
3 women on the ground to prevent terrorist attacks.
4 Creating a registry, the first in
5 the country, to ensure that individuals who have
6 been convicted of a federal or state terrorist
7 act go on a registry, provides an additional data
8 set for our law enforcement and for our
9 intelligence communities to prevent this attack.
10 I want to compliment my colleagues
11 who have supported this bill the last two
12 sessions, and thank you again for the support. I
13 believe this is going to be increasingly
14 important as we go into the future with what
15 we're seeing around the world in these attacks.

24 I want to thank the sponsor for his
25 explanation of why he's voting for his bill. I

1 agree with him that we live in a world where law
2 enforcement needs more tools available to itself
3 constantly to try to deal with proactively
4 protecting us from terrorists. So I think he and
5 I agree on that point.
6 What I don't agree with him on --
7 which is why I'm voting no, Mr. President -- is
8 the concept of a registry that's built under the
9 assumption that you have law-abiding terrorists
10 who will agree to sign up for the registry and be
11 listed. I think actual terrorists probably won't
12 be volunteering to participate to sign up for the
13 registry.
14 But the way this registry is
15 designed, people who have not been accused of
16 anything, had charges brought against them, may
17 end up on a registry that they don't even know
18 they're on until they discover they're on a
19 publicly available lifetime registry that could
20 put them and their families at risk when they
21 haven't been accused, charged, or found guilty of
22 anything.
23 And then it is incumbent on them,
24 when they learn this, to go through the process
25 of finding legal counsel and challenging to

1 remove themselves from a registry, which will be
2 a process of proving a negative, because they
3 haven't been accused, they haven't been charged,
4 they haven't been found guilty.
5 And I am particularly concerned that
6 this model walks us down the road of people of
7 particular name patterns or religions being much
8 more likely to end up on registries where, again,
9 they haven't been accused, charged or found
10 guilty of anything.
11 So, Mr. President, I do believe we
12 owe it to the public to be smart, savvy, have a
13 dynamic government that offers tools to
14 law enforcement that they need to deal with the
15 changing world environment we find ourselves in
16 where our wars and our violence are not
17 necessarily country to country, but home grown.
18 But I also think we have to be much
19 more sophisticated about our ability to respect
20 the Constitution and due process while providing
21 those tools.
22 I vote no, Mr. President.

9 down on child sexual abuse. It is the same bill
10 that passed the Assembly last week by a 139-to-7
11 margin. You should know that 37 Republicans
12 voted in support of that in the Assembly. That's
13 88 percent of the Republicans in the lower house
14 supported the Child Victims Act.
15 I'm hopeful that now that there's
16 been a bill introduced by the Governor that now
17 sits in the Rules Committee, we will finally
18 consider the Child Victims Act in this chamber.

9 the cost of this program, I think a $6 billion
10 differential. And I was wondering, since
11 yesterday, has any clarity ensued and do we have
12 a more definite determination as to what the cost
13 of this program is to the NYSERDA Clean Energy
14 Plan?
15 SENATOR DeFRANCISCO: Before the
16 sponsor responds, could we maintain some order in
17 the house? It's very difficult for the members
18 to hear each other.
19 Senator Flanagan.
20 SENATOR FLANAGAN: Through you,
21 Mr. President. Last night we had differing
22 numbers, some asserted by people outside, at
23 staff level. I stood corrected and corrected
24 myself in terms of what we had from our memo.
25 So the numbers that I mentioned last

1 night are the numbers that I still believe are
2 accurate today.
3 SENATOR HOYLMAN: Would the sponsor

12 gap in the area of $6 billion as to what some
13 independent analysts suggest the cost of this

15 offered last night. And I find that distressing,
16 that we don't have more clarity or that there
17 could be such a wide gap.
18 But I'm curious to know, is the
19 sponsor familiar with what programming the
20 NYSERDA Clean Energy Initiative will have to
21 sacrifice in support of this new initiative?
22 SENATOR FLANAGAN: Yeah, we believe
23 there are sufficient resources so that nothing
24 should have to be sacrificed. And as everyone
25 knows, we are not only a deliberative body but we

1 have a whole budget process. And if we need to
2 make changes down the road, which we do frankly
3 every year, I'm sure that can be taken into
4 account.
5 But as I asserted last night, I
6 believe that we continue to maintain the programs
7 that exist and protect the ratepayers.
8 SENATOR HOYLMAN: Does the sponsor

15 The money is going to have to come
16 from somewhere, though. And the NYSERDA Clean
17 Energy Programs range from solar to electric
18 vehicle rebates, something we authorized in the
19 most recent budget. Does the sponsor have any
20 preference as to what cuts the Clean Energy
21 Program will have to undertake in support of this
22 program? Or are we essentially cutting and
23 leaving NYSERDA to figure it out?
24 SENATOR FLANAGAN: Well, NYSERDA is
25 certainly an independent authority here in the

1 State of New York, and we don't believe that
2 they're going to have to make cuts.
3 SENATOR HOYLMAN: Would the sponsor

16 revenue option that NYSERDA is going to undertake
17 to make up that at least billion-dollar cut that
18 they're going to be undertaking in support of
19 this legislation?
20 SENATOR FLANAGAN: No.
21 SENATOR HOYLMAN: Would the sponsor

2 I ask why the Zero Carbon Emission Investment
3 Program is taking priority in this legislation
4 over other NYSERDA programs? Why not let NYSERDA
5 determine in its wisdom, as the sponsor has
6 asserted that they have the capability to do so,
7 how to figure out how to absorb this cut and
8 maybe place this initiative behind, say, the
9 creation of renewables through solar power?
10 SENATOR FLANAGAN: Mr. President,
11 through you, two parts.
12 Number one, we're talking about zero
13 emissions. And I think even the average person
14 who knows next to nothing about energy policy
15 would understand the idea that the carbon
16 footprint and the more we can reduce emissions is
17 good for everybody.
18 And I'm just going to repeat that
19 whether it's through NYSERDA or through our
20 budgetary process, that we will make sure that we
21 are not only advancing renewables and clean
22 energy, but protecting ratepayers.
23 SENATOR HOYLMAN: On the bill,

2 SENATOR HOYLMAN: Thank you to the
3 sponsor for his responses.
4 I am very concerned about the cost
5 of the Zero Carbon Emission Investment Program,
6 which I think the title alone belies the fact
7 that we are shifting funds out of NYSERDA, funds
8 that we have determined here collectively to be
9 worthwhile, funds that will point toward a new
10 energy future of renewables -- including solar,
11 wind, electric vehicles -- and propping up
12 private industry.
13 I would argue that this -- while the
14 sponsor says it's a way to cover for ratepayers,
15 it's also a way to cover for perhaps mistakes
16 made by the private sector. This is a corporate
17 energy subsidy in the realm of billions of
18 dollars. It actually gives me chills to think
19 that there could be such a wide discrepancy
20 between what independent analysts proffer as the
21 cost and what our friends across the aisle say
22 will be the cost.
23 I find it alarming that we as a body
24 haven't yet analyzed that ourselves to the degree
25 that we feel confident what it will cost, and

1 that there could be such a chasm in what the
2 analysts say and what our colleagues say.
3 I also would say that it's
4 shortsighted. While I think the sponsor is
5 correct in saying that ratepayers need relief,
6 they shouldn't be misled to believe that this
7 solution will provide long-term energy stability.
8 We know that the future of our
9 economy is in green and renewable jobs. We heard
10 last evening that 85,000 jobs at more than
11 7500 businesses across New York State are
12 generated by the clean-energy sector. This
13 legislation before us today is a blow, a serious
14 blow to that sector.
15 Government shouldn't be propping up
16 bad business models. Government should be
17 providing incentives to create new business
18 models, yes. But for us to swoop in after bad
19 decision after bad decision have been made by the
20 private sector, I say enough of that. I don't
21 think that's a Republican ideology; quite the
22 opposite. It sounds like something I might
23 propose at one time or the other. That's why I'm
24 surprised that our friends across the aisle are
25 suggesting such an enormous subsidy for mistakes

1 made by the private sector.
2 Again, we're talking not in the area
3 of millions or tens of millions, hundreds of
4 millions -- we're talking billions of dollars
5 being transferred from the clean energy sector,
6 transferred from an agency that so many of us
7 look to providing a blueprint for renewables, for
8 a future for our kids in the energy sector. And
9 I'm just extremely disappointed.
10 I'm also disappointed that a bill
11 like this comes to the floor, such an important
12 allocation of resources, while we have a
13 simultaneous meeting of another committee of our
14 astute body. I had to run up here at a minute's
15 notice when this bill was being brought to the
16 floor.
17 And if this legislation is truly for
18 the benefit of ratepayers, I'm concerned that
19 we're essentially raiding funds that would help
20 homeowners, ratepayers who have invested
21 significant money through energy-efficient
22 measures.
23 So I think on a whole host of
24 levels -- responsible budgeting, propping up
25 corporate interests, giving a pass to bad

1 decisions made by the private sector, and pulling
2 the rug out from under our energy future, the
3 renewables, including the job creation that's
4 associated with it -- wind, solar, electric
5 vehicles -- we're making a tremendous mistake
6 today with this legislation.
7 Again, I thank the sponsor for his
8 responses to our questions last night and
9 tonight, and I'm glad I got to finish them. But
10 I'll be voting in the negative and urge my
11 colleagues in every part of the state to
12 seriously consider casting a negative vote. This
13 is, I believe, an expensive and irresponsible
14 piece of legislation.

3 SENATOR KRUEGER: Thank you,
4 Mr. President.
5 I remain adamant in my opposition to
6 this bill.
7 The funding for this program will
8 come from the Regional Greenhouse Gas Initiative,
9 RGGI, proceeds in the Clean Energy Fund. Those
10 monies are currently used to support the New York
11 SUN program, the Green Bank, energy efficiency
12 market development programs, research and
13 commercialization initiatives.
14 This move would halt the growth of
15 New York's green sector and threaten tens of
16 thousands of New York jobs. New York currently
17 has 21,000 jobs in renewable power and over
18 110,000 jobs in energy efficiency, including more
19 than 15,000 energy efficiency jobs on Long Island
20 alone.
21 Instead, we would put it into
22 subsidizing the existing but dying nuclear power
23 system. It is true, one can argue, that nuclear
24 power is zero emission. However, it is neither
25 clean nor renewable. And if you ask anybody

1 around Indian Point or perhaps in the country of
2 Japan, they'll tell you it's not safe. It's not
3 a long-term plan for the State of New York. In
4 fact, you're not going to see any more of these
5 built. We'd just be subsidizing a small number
6 of existing jobs, destroying an emerging,
7 growing, exciting opportunity for the State of
8 New York, potentially killing jobs now and
9 certainly into the future.
10 This must be a no vote,
11 Mr. President. Thank you.

14 SENATOR YOUNG: Thank you,
15 Mr. President.
16 I rise to sincerely thank Majority
17 Leader Flanagan for bringing forward this very
18 important piece of legislation. And I would urge
19 a yes vote for the following reasons, because it
20 does a lot of things.
21 First of all, it protects the
22 environment by saving zero emissions power
23 producers. Having these zero emissions
24 facilities operating is necessary to meet the
25 Clean Energy Standard by 2030. That is something

1 that Governor Cuomo has made extraordinarily
2 clear.
3 It saves New York State power
4 generators so that we can grow manufacturing
5 jobs. If we don't have baseload plants in
6 upstate New York especially, we will never be
7 able to bring back the manufacturing sector.
8 It saves thousands of jobs that
9 currently exist at these facilities right now.
10 And I have to disagree with my
11 colleagues because there are resources available
12 through NYSERDA to cover these costs and still do
13 a lot of the other projects that they're speaking
14 of.
15 And this legislation, most
16 importantly to the people of my district, takes
17 the multi-billion heavy burden of the surcharge
18 that was unilaterally imposed by the Public
19 Service Commission and that will go on the
20 ratepayers -- it takes that burden off of the
21 ratepayers. It will take it off of senior
22 citizens, families, schools, small businesses and
23 manufacturers.
24 And we all have people in our
25 districts that are struggling to pay their bills

1 right now. If you don't support this
2 legislation, you're basically voting to burden
3 the ratepayers with these heavy costs at a time
4 when they can least afford it.
5 So, Mr. President, I very
6 enthusiastically vote yes, and I encourage all of
7 our colleagues to do the same.

12 SENATOR LaVALLE: Thank you,
13 Mr. President.
14 This legislation is relief for
15 ratepayers.
16 But in listening to Senator Krueger
17 and Senator Hoylman, it's like nothing else is
18 taking place in this state in terms of
19 renewables. In the First Senate District, we
20 have a one-mile solar farm on Brookhaven National
21 Lab. In Shoreham, what was a sod farm is a solar
22 farm, to be followed by another project on a golf
23 course, solar. In Riverhead, the town has -- the
24 county has used solar carports and earned some
25 revenue. And in Senator Croci's district in

1 Patchogue, Brookhaven Town has also used carports
2 that are solar.
3 So there's a lot happening. There
4 are a lot of private companies that are pushing
5 the envelope to get into solar projects. And in
6 terms of wind energy, we will be starting a
7 project off of Montauk. So there is stuff
8 happening, and the world is not dark in terms of
9 renewable energy. A lot of things are happening.
10 I vote in the affirmative.

15 Mr. President. To explain my vote.
16 I'll be voting in the negative. And
17 I just heard my colleague Senator LaValle list
18 all the good things that are happening in his
19 district as it relates to renewable energy. And
20 that is precisely the point. This bill allows
21 the funding that enabled those projects to come
22 to fruition to be diverted for another purpose.
23 And so if Senator LaValle and others
24 who want to support this bill are so proud of the
25 things that are happening, they should vote

1 against this bill because fewer projects like
2 that will be occurring as a result of this bill
3 passing.
4 The NYSERDA funding that is going
5 towards those renewable projects will now be sent
6 to subsidize nuclear power in another part of the
7 state, and we'll be doing damage to our effort to
8 create more renewable energy here in New York.
9 And so I wanted to clear the record
10 up on that and explain my vote strongly against
11 this bill. Thank you.

16 Mr. President. I rise to explain my vote.
17 I'll be voting yes on this. And I
18 have in my district a nuclear power plant, and
19 just wanted to share some of the facts and some
20 of the reasons why I will be voting yes.
21 Ginna Nuclear Generating Station is
22 located in Ontario, which is in Wayne County.
23 Ginna supports over 4,000 direct and indirect
24 jobs and is responsible for billions in state
25 economic development. The facility offsets

1 3 million tons of carbon dioxide emissions
2 annually, while powering over 500,000 homes. The
3 Ginna facility is critical to our energy grid.
4 Nuclear power provides reliable,
5 clean baseload power as well as cost stability in
6 the energy market. If Ginna were taken offline,
7 there would be greater reliance on natural gas
8 for baseload power, which has higher emissions.
9 The ZEC subsidy will only allow
10 Ginna to receive enough funds to -- I'm sorry, I
11 don't want to -- I'll skip that.
12 Again, I just want to say I'll be
13 voting yes because Ginna provides jobs; it's
14 reducing the burden on the ratepayers, both the
15 small businesses and the residents; and it's good
16 for our environment. And I believe that there is
17 adequate funding in NYSERDA to support the
18 nuclear power plants and, in addition, to support
19 the solar, wind and other clean energy projects.
20 So I'll be voting in the
21 affirmative. Thank you.

2 And I appreciate their different perspectives.
3 It is obviously a regional difference here.
4 I wish we could have come together
5 as a chamber and perhaps hammered out a solution
6 that wouldn't leave us in this huge
7 misunderstanding as to how much this is going to
8 cost. I think that is truly, truly a mistake
9 that there is such an enormous gulf of expense.
10 And to suggest that NYSERDA can recover from
11 anywhere from a $2.5 billion to $7.5 billion cut
12 I think is unrealistic.
13 I also think that this is going to
14 undermine the Governor's attempts to make certain
15 that New York reaches its 50 percent renewable
16 goal by 2030. Of course we're cutting RGGI, as
17 my colleagues have noted, the Regional Greenhouse
18 Gas Initiative.
19 And at a time when our federal
20 government is withdrawing the United States of
21 America from the Paris climate accords, we should
22 be doing the opposite in this chamber. We should
23 be looking at ways to make up for that
24 irresponsible decision by Washington to remove
25 our federal efforts from clean energy and reduced

1 global emissions, not contribute to them through
2 this measure today. We need to have our own
3 version of the Paris climate accord in Albany to
4 figure out how we can contribute to reducing
5 carbon emissions.
6 I respectfully urge my colleagues to
7 vote in the negative.

18 people who live in Dutchess, Putnam, Rockland and
19 Orange, does not include people who live in
20 Nassau, Suffolk --

2 residents of Nassau County, Suffolk County, and
3 Westchester County. Those three counties have
4 the same situation as those in the four counties
5 that are mentioned in this bill.
6 I had hoped a year ago that the
7 bill, when resubmitted, would include all of the
8 suburban counties. It does not. So in good
9 conscience, representing people in Westchester
10 County, I cannot support this bill. Not because
11 I don't see the problem of Dutchess, Putnam,
12 Orange and Rockland, but that Westchester and the
13 two Long Island counties ought to be included in
14 this bill.
15 So I appreciate the opportunity to
16 speak, and I will be recorded in the negative.
