What's happening

This bill prohibits issuing permits for marine solid waste transfer stations within 800 feet of public housing in large cities.

Why it matters

  1. Targets environmental justice concerns. By banning marine solid waste transfer stations near public housing, the bill addresses longstanding issues of disproportionate environmental burdens on low-income and minority communities, aiming to reduce exposure to pollutants and related health risks.

  2. Sets a clear, enforceable standard. The 800-foot buffer creates a specific, measurable zone of protection, making it easier for both agencies and the public to understand and enforce the law, potentially preventing controversial siting decisions before they happen.

  3. Limits local discretion and closes loopholes. The bill overrides any conflicting state or local laws or regulations, ensuring that no permits or approvals—new or renewed—can be issued for these facilities within the defined proximity, thus reducing opportunities for exceptions or regulatory workarounds.
