What's happening
This bill bans the sale or use of liquid waste from hydraulic fracturing and requires new disposal regulations for such waste.
Why it matters
Targets both sale and use. By banning not just the sale but also the use of liquid waste from hydraulic fracturing (such as fracking brine), this bill closes loopholes that might allow such waste to be repurposed or distributed for uses like road de-icing or dust suppression, which have raised environmental and health concerns.
Forces regulatory action. The Department of Environmental Conservation is required to create comprehensive rules for the disposal of all fracking-related waste, meaning disposal practices will be standardized and subject to oversight, which could help prevent improper dumping or storage.
Accelerates regulatory timeline. The bill mandates that these new disposal regulations be developed within 90 days, establishing a swift timeline and signaling urgency in addressing potential risks associated with fracking waste.
Public health and environmental impact. By restricting both the use and improper disposal of liquid fracking waste, the bill aims to reduce potential contamination of water supplies, soil, and ecosystems, directly addressing ongoing concerns about toxic chemicals and radioactive materials sometimes found in such waste.
