What's happening

This bill prohibits New York State from charging vendors re-registration fees to collect sales tax and refunds previously collected fees.

Why it matters

  1. Reduces cost and administrative burden for businesses. By eliminating the $50 re-registration fee, the bill lowers a recurring expense and paperwork obstacle for vendors, making it easier and less costly to do business in New York.

  2. Retroactively benefits vendors. The bill mandates refunds for all previously collected re-registration fees since November 1, 2008, potentially returning significant funds to businesses that have already paid these charges.

  3. Signals a shift in state policy toward business friendliness. Preventing the Department of Taxation and Finance from charging any fees for the privilege of collecting sales tax may encourage new business formation, reduce friction with the state, and demonstrate responsiveness to business community concerns.

  4. Removes a source of discretionary revenue for state administration. The bill limits the state's ability to cover the administrative costs of tax registration through direct fees on vendors, which could impact how these costs are funded in the future.

The provisions of subdivisions (a) and (c) of section 1139 of the tax law apply, except that no interest is allowed or paid on any refund.] A person may be subject to the re-registration program directed by this section even if such person holds a certificate of authority that has not been in effect for a period of at least three years.

§ 2. Notwithstanding any law, rule or regulation to the contrary, all 50 dollar application fees collected by the department of taxation and finance pursuant to the re-registration program instituted by the commissioner of taxation and finance as authorized by section 1 of part LL-1 of chapter 57 of the laws of 2008 shall be refunded to the persons who paid such fees.

§ 3. Paragraph 5 of subdivision (a) of section 1134 of the tax law, as amended by chapter 2 of the laws of 1995, is amended to read as follows:
