What's happening

This bill requires the inclusion of assessed value changes from properties under payment in lieu of taxes agreements when calculating local and school tax quantity change factors.

Why it matters

  1. By including changes in assessed value for properties under payment in lieu of taxes (PILOT) agreements, local governments and school districts will have a more accurate picture of total property value growth in their tax base—even if some of that growth is currently tax-exempt. This impacts the calculation of quantity change factors, which influence how much local governments and schools can increase their property tax levies under New York’s tax cap law.

  2. This adjustment could allow for higher permissible tax levy increases in areas experiencing new development or property improvements on PILOT properties, reflecting the true expansion of taxable property resources. Without this change, increases in property value from PILOT projects wouldn’t affect tax cap calculations, potentially restricting public budgets despite economic growth.

  3. The change also enhances transparency and fairness in tax cap calculations by ensuring all significant changes in local property value—whether taxable or under a PILOT agreement—are treated similarly. This could reduce disparities between communities with significant PILOT activity and those without, and prevent undercounting of new development when setting budget limits.
