What's happening

This bill requires both teachers and public employees, and their employers, to sign and file a written acknowledgment when terminating membership in New York State retirement systems.

Why it matters

  1. Ensures informed decision-making. By requiring both the employee and employer to sign a written acknowledgment, the bill makes sure that members are fully aware of the consequences of leaving the retirement system, helping to prevent accidental or uninformed terminations.

  2. Protects retirement benefits. The formal process may reduce the risk of employees unintentionally forfeiting valuable retirement benefits, since both parties must confirm their understanding and intent before termination is finalized.

  3. Strengthens employer accountability. Mandating that employers file the signed acknowledgment within 30 days creates a clear administrative responsibility, reducing the likelihood of processing errors or delays that could adversely affect employees’ retirement status.

  4. Standardizes exit procedures across systems. By applying similar requirements to teachers and other public employees in different state retirement systems, the bill creates consistency and clarity in how membership terminations are handled, benefiting both employees and administrators.
