What's happening

This bill adds alpha-PVP and its chemical variants to New York's list of Schedule I controlled substances.

Why it matters

  1. Expands legal tools for law enforcement. By explicitly listing alpha-PVP and its chemical variants as Schedule I substances, police and prosecutors can more easily charge and convict individuals involved in the manufacture, sale, or possession of this drug.

  2. Addresses public health concerns. Alpha-PVP (commonly known as "flakka" or "gravel") has been linked to dangerous side effects and erratic behavior; adding it to Schedule I signals the state’s recognition of its high abuse potential and lack of accepted medical use.

  3. Closes legal loopholes. Including not just alpha-PVP but also its salts and optical isomers helps prevent chemists from creating slightly altered versions of the drug to evade prosecution under existing drug laws.

  4. May impact research and medical exploration. As a Schedule I substance, alpha-PVP will face significant restrictions, potentially hindering any future scientific or medical research into its properties or effects.
