What's happening

This bill ensures that adoption petitions cannot be denied solely because the petitioner's parentage is already legally recognized in New York.

Why it matters

  1. Protects families seeking additional legal security. This bill ensures that parents whose parentage is already recognized by New York law can still pursue an adoption, which can provide additional legal protections—such as recognition in other states or countries that may not honor New York’s parentage laws.

  2. Reduces discrimination and uncertainty. By clarifying that recognized parents cannot be denied adoption solely for that reason, the bill helps prevent arbitrary or discriminatory refusals that might particularly impact LGBTQ+ families, blended families, or those formed through assisted reproduction.

  3. Offers peace of mind in complex family situations. Some families may seek adoption orders as a safeguard for travel, inheritance, or medical decision-making. This legislation ensures their petition cannot be denied just because their relationship is already recognized, giving families more control over their legal security.
