What's happening
This bill allows New York Medicaid to cover disabled residents who require continuous medical care while attending out-of-state colleges.
Why it matters
Supports educational access for disabled students. By ensuring Medicaid coverage continues for those attending out-of-state colleges, the bill removes a major barrier for disabled New Yorkers who require ongoing medical care, potentially expanding their higher education options.
Prevents gaps in critical health services. The bill guarantees that disabled individuals can maintain their established care regimens—such as medications, therapies, or treatments—while living temporarily outside New York for educational purposes, reducing risks to their health.
Clarifies residency requirements. The bill explicitly defines “domiciliary” and “domicile,” ensuring that only those who remain permanent New York residents (even while temporarily out-of-state) are eligible, which helps prevent misuse and maintains the focus on genuine residents.
Requires regular proof of college enrollment. By mandating semester-by-semester verification, the legislation adds accountability and ensures that the benefit applies strictly to those actively pursuing education outside the state.
