What's happening

This bill strengthens enforcement and penalties for violations of New York's freshwater wetland laws, including daily fines and required restoration.

Why it matters

  1. Imposes daily penalties for ongoing violations. , meaning each day that a violation continues counts as a new, separate offense—potentially leading to much higher cumulative fines for non-compliance.

  2. Mandates restoration of damaged wetlands or adjacent areas. , requiring violators to return affected land to its original state when possible, not just pay financial penalties.

  3. Expands enforcement authority. by allowing both the state and local governments to issue cease-and-desist orders and oversee restoration efforts, increasing the likelihood of prompt and effective action.

  4. Directs collected fines to the Environmental Protection Fund. , ensuring that penalty money is used to further environmental protection and conservation efforts in New York.
