What's happening
This bill allows certain adult care facilities in New York to arrange for limited nursing services for residents under specific regulations.
Why it matters
Expands care options for residents. By permitting adult care facilities to arrange limited nursing services, this bill allows residents to receive certain medical support on-site without needing to move to higher-level care settings, potentially supporting health needs while maintaining independence.
Maintains regulatory safeguards. The nursing services provided must comply with specific limits and cannot violate existing admission or retention standards, ensuring these facilities do not exceed their intended level of care or become substitutes for full nursing homes.
Prevents misleading advertising. Operators offering these nursing services are explicitly barred from marketing themselves as “enhanced assisted living residences” or claiming to provide “aging in place” services unless they meet stricter legal definitions, protecting consumers from confusion or overpromising of care levels.
