What's happening

This bill prohibits the sale, manufacture, transfer, or possession of flamethrowers in New York, with exceptions for certain uses and historical devices.

Why it matters

  1. Defines “flamethrower” broadly. to include any device that can project burning fuel at least six feet, but excludes inoperable display units—meaning even non-military, commercially available models could be covered by the law.

  2. Allows specific exceptions. for historical flamethrowers (mainly those made with pre-1966 components), agricultural use, and film/TV production, acknowledging legitimate non-weaponized uses while still placing limits on general public possession.

  3. Grandfathers in legally acquired devices. by permitting continued possession of flamethrowers owned before the law takes effect, which matters for collectors or those who already use such equipment legally.

  4. Imposes only civil (not criminal) penalties. for violations, with a $250 fine for a first offense and $500 for subsequent offenses, signaling a regulatory rather than punitive approach while still aiming to deter casual misuse or illegal trade.
