What's happening

This bill bans the acceptance and disposal of high volume hydraulic fracturing wastewater at New York wastewater and solid waste facilities.

Why it matters

  1. Closes loopholes that previously allowed hydraulic fracturing (fracking) wastewater from out-of-state sources to be processed or disposed of in New York, even though fracking itself is already banned in the state.

  2. Reduces the risk of contamination to New York's water supplies and environment by prohibiting the introduction of fracking waste—including flowback water, production water, and brine—at both wastewater treatment plants and solid waste management facilities.

  3. Limits the burden on local infrastructure and public health systems that could result from handling toxic and potentially radioactive waste by ensuring such materials cannot legally enter New York’s waste streams.

  4. Signals a broader commitment to environmental protection in state policy, potentially influencing similar measures in other states or at the federal level, and reinforcing New York’s stance on fossil fuel-related environmental risks.
