What's happening
This bill imposes a four-year moratorium on Mitchell-Lama building shareholders holding another vote after a failed privatization attempt.
Why it matters
Protects housing stability for residents. By imposing a four-year waiting period after a failed privatization vote, the bill aims to reduce repeated, potentially destabilizing privatization attempts in Mitchell-Lama buildings, giving residents greater security about their housing status.
Limits pressure campaigns and voting fatigue. Frequent votes on privatization can create ongoing pressure and division among residents. This moratorium helps prevent relentless campaigns that can wear down opposition through repeated ballots.
Upholds local control and stronger protections. The bill specifically allows cities, towns, or villages to enact even stricter rules, meaning local governments can provide greater protections if they see fit, rather than being limited to the state standard.
Reinforces existing legal safeguards. By clarifying that the moratorium does not override other applicable laws, the bill ensures that it works alongside, rather than weakening, other legal requirements related to housing and privatization processes.
