What's happening

This bill prohibits the sale or distribution of electronic liquids for refilling e-cigarettes, except for prefilled, sealed cartridges.

Why it matters

  1. Limits access to bulk or refillable e-liquids, aiming to reduce the risk of accidental poisoning and misuse, especially among children and teens who could be exposed to open containers of nicotine.

  2. Could significantly impact vape shops and small businesses that currently mix or sell custom e-liquids, shifting the market toward larger manufacturers providing only sealed, prefilled cartridges.

  3. Allows for a potential exemption for in-state e-liquid manufacturers, giving the state flexibility to support local industry or impose stricter oversight as needed.

  4. Introduces enforceable penalties for violations, which could deter illegal sales but may also require increased enforcement resources at the local level.

Section 1. The general business law is amended by adding a new section 391-u to read as follows:

§ 391-u. Electronic liquids or e-liquids; prohibition. 1.
