What's happening

This bill allows police and peace officers in New York to impound vehicles if the driver cannot provide proof of insurance.

Why it matters

  1. Immediate Consequences for Drivers. The bill gives police and peace officers the authority to impound vehicles on the spot if the driver can't provide proof of insurance, raising the stakes for drivers who forget or lack documentation.

  2. Public Safety and Financial Responsibility. By making it easier to remove uninsured vehicles from the road, the measure aims to reduce risks for other drivers and incentivize compliance with insurance requirements.

  3. Potential for Disproportionate Impact. The policy could disproportionately affect lower-income individuals or those who may face barriers to promptly accessing or providing insurance documents, leading to additional financial and logistical burdens.

  4. Increased Law Enforcement Discretion. The change amplifies police officers' power during traffic stops, potentially affecting interactions between law enforcement and the public and raising questions about consistent application and oversight.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. Subdivision 3 of section 319 of the vehicle and traffic law, as amended by chapter 843 of the laws of 1980, is amended to read as follows:

3. Every person who operates a vehicle registered in this state, or a vehicle required to be registered in this state, shall, when required by the commissioner's regulations, produce an insurance identification card when requested by any peace officer, acting pursuant to his special duties, police officer or magistrate.
