What's happening

This bill allows Yeshiva Bais Chaya Esther INC to apply retroactively for water and sewer charge exemptions in Brooklyn for 2013–2016.

Why it matters

  1. Provides a rare opportunity for retroactive relief. This bill allows Yeshiva Bais Chaya Esther INC to seek exemptions for water and sewer charges from past years (2013–2016), which is not typically permitted under standard city procedures, potentially setting a precedent for other nonprofits facing similar issues.

  2. Could result in significant financial benefit. If the exemption is granted, the yeshiva may have all outstanding water and sewer charges, as well as related fines, penalties, and interest, canceled for those years—substantially reducing the organization’s financial burden.

  3. Requires city council oversight and approval. The commissioner of the NYC Department of Environmental Protection cannot grant this relief unilaterally; approval by the New York City Council is required, ensuring that there is public and governmental review before any exemptions are finalized.

Who cares

  • Yeshiva Bais Chaya Esther INC

The bill would let the nonprofit seek a retroactive water and sewer exemption for fiscal years 2013 through 2016 for its Brooklyn property at block 5416, lot 1, potentially clearing unpaid charges, fines, penalties and interest.

  • New York City Department of Environmental Protection

Its commissioner would be authorized to accept and review the retroactive application and, if eligibility requirements are met, grant relief with City Council approval.

  • New York City Council

The council would have an approval role before the commissioner could grant the exemption and cancel unpaid amounts.

AN ACT to authorize Yeshiva Bais Chaya Esther INC to file an application for exemption from water and sewer charges for certain assessment rolls

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. Notwithstanding any other provision of law to the contrary, the commissioner of the New York city department of environmental protection is hereby authorized to accept from Yeshiva Bais Chaya Esther INC, a not-for-profit corporation, an application for exemption from water and sewer charges pursuant to chapter 696 of the laws of 1887, as amended, for the fiscal years of 2013 through 2016, for the parcel owned by such corporation in the city of New York, borough of Brooklyn, designated as block 5416, lot 1 in such borough. If accepted, the application shall be reviewed as if it had been received for fiscal years 2013 through 2016.

If satisfied that such corporation would otherwise be entitled to such exemption if such corporation had filed an application for exemption for fiscal years 2013 through 2016, the commissioner of the New York city department of environmental protection, upon approval by the city council of the city of New York, may grant exemption from all water and sewer charges with respect to the subject water and sewer charges due and owing by such corporation on the effective date of this act and cancel charges, fines, penalties and interest remaining unpaid.
