What's happening

This bill requires all New York schools to have on-site nebulizers, include nebulizer instruction in health classes, and provides state funding for implementation.

Why it matters

  1. Expanded access and readiness. The bill mandates that all public and private school buildings—including charter schools and vocational/extension boards—must have a working nebulizer on-site, available during all hours and events, not just where nurses are present. This expands access for students with respiratory needs, such as asthma, and ensures preparedness during emergencies.

  2. Standardized student instruction. By requiring instruction in the correct use of nebulizers as part of high school health education (alongside CPR), the bill aims to increase general student knowledge about respiratory emergencies and empower more individuals to respond effectively.

  3. Training and liability protection for staff. The legislation requires that at least one staff member trained in nebulizer use be present at school events, including off-site athletic contests. It also provides legal protection for employees or agents who voluntarily use a nebulizer in an emergency, encouraging staff to assist without fear of legal repercussions.

  4. State funding for implementation. The bill includes a direct state appropriation to reimburse school districts and educational service boards for the cost of purchasing, maintaining, and providing training for nebulizers, helping ensure the financial burden does not fall solely on local schools.
