What's happening
This bill requires contractors to promptly report ending relationships with minority and women-owned businesses on public projects or face fines.
Why it matters
Increases transparency and accountability. by requiring contractors to notify both the project owner and the Division of Minority and Women's Business Development if they end partnerships with minority and women-owned businesses before a public project is completed.
Aims to protect the integrity of MWBE participation goals. by making it harder for contractors to quietly drop minority and women-owned business partners after winning contracts, helping ensure these businesses actually benefit from public projects.
Introduces financial consequences for non-compliance. , with fines determined by the division director, creating a direct incentive for contractors to promptly report changes and potentially deterring bad-faith practices.
Could improve data collection and oversight. for public agencies, allowing them to monitor MWBE involvement more closely and identify patterns of premature contract terminations.
