What's happening
This bill allows possession of large capacity ammunition feeding devices manufactured before September 13, 1994, in New York.
Why it matters
Expands legal firearm accessory ownership. By allowing possession of pre-1994 large capacity magazines, the bill broadens what gun owners in New York can legally possess, potentially affecting collectors, sports shooters, and those with inherited firearms.
Directly counters post-2013 NY SAFE Act restrictions. The SAFE Act severely limited magazine capacities; this amendment would roll back part of those restrictions for a specific class of older magazines, reflecting ongoing debates about the balance between public safety and gun rights.
Potential impact on law enforcement and public safety. Legalizing possession of these magazines could complicate enforcement efforts, as police would need to determine the manufacture date of magazines, possibly increasing the burden on law enforcement and affecting how gun-related crimes are prosecuted.
Retroactive application. By making the law effective as of January 15, 2014, the bill could shield some individuals from prosecution for possession of such magazines during the intervening years, which may have legal and practical consequences for pending or past cases.
