What's happening

This bill prohibits landlords from charging fuel adjustment or pass-along rent increases to tenants in rent-controlled apartments in New York City.

Why it matters

  1. Limits rent increases for vulnerable tenants. By banning fuel adjustment and pass-along charges, the bill ensures rent-controlled tenants are shielded from sudden rent spikes linked to fluctuating energy costs, providing them with more predictable and stable housing expenses.

  2. Reduces risk of displacement. Many rent-controlled tenants are elderly or on fixed incomes. Eliminating these surcharges helps prevent situations where rising utility costs could make their homes unaffordable and potentially lead to displacement.

  3. Clarifies and strengthens tenant protections. The bill overrides any conflicting laws or regulations, making it explicit that landlords cannot impose these types of surcharges, closing loopholes and simplifying enforcement for both tenants and housing authorities.

  4. Temporary measure tied to ongoing emergency. The prohibition remains in effect only as long as New York’s rent control emergency is declared, connecting tenant protections to broader housing market conditions and the recognized need for regulation.
