What's happening

The bill prohibits approval of wind electric generation facilities within 40 miles of any active federal military airfield or airbase in New York.

Why it matters

  1. Impacts clean energy development. By restricting wind facility permits near military airfields, the bill could limit where new wind projects can be built, potentially slowing New York’s ability to expand renewable energy infrastructure and meet climate goals.

  2. Prioritizes military operational safety. The bill addresses concerns about wind turbines interfering with radar, flight paths, training, or other military operations, aiming to protect national security and ensure the full functionality of military installations.

  3. Affects local economies and land use. Communities within 40 miles of active military airfields may lose potential economic benefits from wind projects, such as jobs, lease payments, and tax revenue, altering future land use and investment opportunities.

  4. Establishes a clear legal standard. By setting a specific 40-mile restriction, the legislation offers clarity for developers, local governments, and military planners, but may also be seen as a blunt tool that doesn’t account for site-specific impact assessments or mitigation options.

Who cares

  • Wind energy developers

The bill would bar certificates for construction or operation of wind electric generation facilities within 40 miles of an actively used airfield or airbase under federal military jurisdiction.

  • State power facility siting board

The bill would prohibit the board from granting certificates for wind facilities in the specified areas.

  • Federal military departments

Their actively used airfields and airbases would determine where the 40-mile restriction on wind facility certification applies.
