What's happening

This bill allows damages in New York antitrust cases to be recovered through court-authorized class action lawsuits.

Why it matters

  1. Empowers groups of consumers and businesses. By allowing class action lawsuits for antitrust damages, individuals or small companies harmed by anti-competitive practices can band together, making it more practical and affordable to pursue claims that might be too costly on their own.

  2. Increases potential financial risks for violators. Companies found to be violating antitrust laws could now face much larger damage awards, since class actions can aggregate the claims of many affected parties, potentially leading to significant financial penalties.

  3. Strengthens enforcement of antitrust laws. The threat of class actions may deter companies from engaging in anti-competitive behavior, as the likelihood of being sued—and the scale of possible damages—rises dramatically.

  4. Aligns New York with federal and other state practices. Many jurisdictions already allow class actions for antitrust violations. This change could make New York a more consistent and effective venue for addressing market abuses and protecting competition.
