What's happening

This bill prohibits the use or application of sludge and sewage sludge on land in the town of Marilla, Erie County.

Why it matters

  1. Protects Local Public Health. By prohibiting the land application of sludge and sewage sludge, the bill aims to reduce potential risks from contaminants, pathogens, or heavy metals that could seep into soil, water supplies, or the food chain.

  2. Defines Key Terms for Enforcement. The bill spells out what constitutes "sludge" and "sewage sludge," making it clear what materials are covered. This clarity helps local officials enforce the ban and prevents loopholes.

  3. Targets Both Public and Private Sources. The definition of sewage sludge includes waste from both public and private treatment plants, ensuring that the restriction applies broadly and cannot be circumvented by shifting to private operations.

  4. Sets a Local Environmental Precedent. Marilla would join a small number of localities in New York with such restrictions, potentially setting an example for other towns concerned about land application of waste byproducts.

Who cares

  • Town of Marilla officials

The bill would authorize the town to prohibit sludge or sewage sludge use on land within its boundaries when that use would affect public health.

  • Marilla landowners and sludge applicators

Sludge use or application on their land could face a town prohibition tied to public health.

  • Wastewater, water supply and air pollution treatment facility operators

Waste generated by these facilities falls within the bill’s sludge definition and could be barred from land application in Marilla.
