What's happening

This bill requires anyone operating an aircraft in New York to pass a breathalyzer test before boarding.

Why it matters

  1. Raises aviation safety standards. by legally requiring all aircraft operators to prove sobriety before every flight, potentially reducing the risk of accidents related to alcohol impairment.

  2. Imposes a clear, enforceable threshold. (.08 BAC) for all pilots, mirroring the blood alcohol limit used for drivers, which could lead to more consistent enforcement and expectations across transportation sectors.

  3. Could affect both commercial and private aviation. , meaning hobbyist pilots, charter operators, and commercial airline pilots alike would be subject to the same pre-flight breathalyzer requirement, potentially impacting how flight operations are conducted and scheduled in New York.
