What's happening

This bill creates a tax credit for individuals and businesses that recycle oyster shells in New York State.

Why it matters

  1. Incentivizes environmental stewardship. By providing a financial reward for recycling oyster shells, the bill encourages individuals and businesses to participate in shell recycling, which supports coastal restoration and marine habitat health.

  2. Caps and oversight guard against abuse. The credit is limited to either $1,000 or ten cents per pound of certified shells, whichever is less, and requires certification by the Department of Environmental Conservation, ensuring only verified recycling efforts are rewarded.

  3. Promotes Department of Environmental Conservation’s role. The bill mandates the creation of rules for verifying and certifying recycled shells, giving the Department a key role in ensuring shells are properly recycled and used, which could improve transparency and program effectiveness.

  4. Potential to boost local economies and sustainability efforts. By making shell recycling more attractive, the bill may encourage restaurants, seafood processors, and other businesses to participate in environmentally beneficial practices that can also contribute to local restoration projects and eco-tourism.
