What's happening

This bill designates uniformed fire marshals in the Town of Huntington as peace officers when performing their special duties.

Why it matters

  1. Expands Legal Authority for Fire Marshals. By designating Huntington’s uniformed fire marshals as peace officers, the bill gives them additional legal powers (such as making arrests or issuing summonses) when handling fire-related incidents, which can improve enforcement of fire codes and safety laws.

  2. Potentially Enhances Public Safety. Granting peace officer status allows fire marshals to respond more effectively to emergencies and violations, possibly leading to quicker resolutions and increased deterrence of fire hazards or arson.

  3. Limits on Firearm Carry. Despite the new status, the bill specifically maintains strict controls on firearms—fire marshals may only carry firearms if they have the proper license—limiting the expansion of their authority to non-lethal law enforcement duties unless otherwise permitted by law.

  4. Consistency Across Localities. The bill aligns Huntington with neighboring towns (Southampton and Riverhead), ensuring fire marshals in these areas operate under similar legal frameworks, which can streamline cooperation and mutual aid during regional incidents.
